Right in their faces. "Look Judge I pay your salary now do your job". Such have been the cases by certain Banks who have finally been caught with their hands in the cookie jar "double dipping". Stealing from the private investors, insurance companies, and the public Tarp and HUD money. How does this RICO Scheme work? Very quickly, quietly, and efficiently for them. Billions and billions and more billions disappeared using the following very effective modus operandi: First, starting in 2000, you grab government money and lend it out to every American that wants to buy a home knowing that they will fail in making their payments on time sooner than later. It is just a question of time. Then once they default you collect the insurance money from the FDIC, and sell the documents to the government and claim to be "servicing" the loan, in other words receiving the payments, taking a 6% commission, and allegedly sending on the rest to the Federal entity. In most cases for Fannie Mae. The funny thing is the money the homeowner has been paying the alleged "servicer" never gets them. Such is the case that shares in Fannie Mae were $80.00usd in 2008, and down to $1 or may $2 today. in 2019. Where did the rest of the money disappear to? Where was in laundered to? Many of the Banks in Europe? Or in other safe havens?Once the gig is discovered, homeowners show up in Federal Courts across the country either representing themselves "Pro Se" or as "Qui Tam Relators" using the provisions of the False Claims Act ( FCA ), and expose the fraud as whistle blowers. They show up with two (2) different notes as evidence. The first note is the one they signed as the original documents at closing. The second one is a forged "robo-signed" and "endorsed" one by some unknown individual, on some unknown date, on behalf of the alleged holder of the promise to pay or note. All fraudulent of course, and which should be immediately be considered to be "FRAUD ON THE COURT" pursuant to Federal Rules of Civil Procedure ( FRCP ) number 60, but never is. So sad that some or all of our Federal Judges appear to be "on the take" by ignoring the obvious irrefutable evidence presented to them by homeowners simply fighting to save their families from becoming homeless in the wealthiest country in the world?We at Americans Against Foreclosures ( AAF ) are a non-profit Organizations created to help homeowners when the foreclosure tragedy begins.
