Since the early 1970's there have been significant changes in the conditions governing the exploitation of marine fishery resources. These changes include the generalized extension of national jurisdiction over fisheries to 200 nautical miles; the decline in the rate of growth of world catch and the growing evidence of limits to supply; and the changes in economic conditions including the rise in fuel prices and the economic recessions. The New Entrants Problem in International Fisheries Law
Author: Andrew Serdy
Publisher: Cambridge University Press
ISBN: 1316194159
Category : Law
Languages : en
Pages : 515
Book Description
Are international fisheries heading away from open access to a global commons towards a regime of property rights? The distributional implications of denying access to newcomers and re-entrants that used the resource in the past are fraught. Should the winners in this process compensate the losers and, if so, how? Regional fisheries management organisations, in whose gift participatory rights increasingly lie, are perceptibly shifting their attention to this approach, which has hitherto been little analysed; this book provides a review of the practice of these bodies and the States that are their members. The recently favoured response of governments, combating 'IUU' - illegal, unregulated and unreported - fishing, is shown to rest on a flawed concept, and the solution might lie less in law than in legal policy: compulsory dispute settlement to moderate their claims and an expansion of the possibilities of trading of quotas to make solving the global overcapacity issue easier.

Boats to Burn
Author: Natasha Stacey
Publisher: ANU E Press
ISBN: 1920942955
Category : Sports & Recreation
Languages : en
Pages : 242
Book Description
Under a Memorandum of Understanding between Indonesia and Australia, traditional Indonesian fishermen are permitted access to fish in a designated area inside the 200 nautical mile Australian Fishing Zone (AFZ). However, crew and vessels are regularly apprehended for illegal fishing activity outside the permitted areas and, after prosecution in Australian courts, their boats and equipment are destroyed and the fishermen repatriated to Indonesia. This is an ethnographic study of one group of Indonesian maritime people who operate in the AFZ. It concerns Bajo people who originate from villages in the Tukang Besi Islands, Southeast Sulawesi. It explores the social, cultural, economic and historic conditions which underpin Bajo sailing and fishing voyages in the AFZ. It also examines issues concerning Australian maritime expansion and Australian government policies, treatment and understanding of Bajo fishing. The study considers the concept of "traditional" fishing regulating access to the MOU area based on use of unchanging technology, and consequences arising from adherence to such a view of "traditional"; the effect of Australian maritime expansion on Bajo fishing activity; the effectiveness of policy in providing for fishing rights and stopping illegal activity, and why Bajo continue to fish in the AFZ despite a range of ongoing restrictions on their activity.
