Fisheries law enforcement, from investigation to judgement, continues to be an expensive and lengthy process in many jurisdictions. Many countries - particularly developing countries - experience such a significant backlog of pending trials for conventional criminal offences that dealing with fisheries offences is not a priority. This study suggests considering the use of administrative sanctions as a direct response to the problem and examines the administrative systems for dealing with fisheries offences in a diverse range of countries from different legal systems. It is intended to assist states in identifying the issues they need to take into account when considering the adoption of such a scheme. It is expected that the study will be especially valuable to developing states seeking to adopt a cost effective means of dealing with illegal, unreported and unregulated fishing, but which nonetheless wish to ensure that the basic individual rights of the accused are protected.

In recent years, many countries have significantly revised their existing legislation or adopted new legal frameworks for the protection and management of wildlife. This study assesses the current status of national wildlife laws around the world, with a particular emphasis on legal innovations that have emerged over the last decade. In this publication, a number of recognized practitioners and scholars undertake to explore the realities and the conceptual underpinnings of environmental compliance mechanisms. In a relatively short period of time, such mechanisms were introduced in a wide range of new and existing environmental regimes. Yet, little is known about their function in practice and their implications. This is puzzling when considering, that the new mechanisms considerably depart from traditional patterns of counteraction and dispute settlement. Instead they build on partnership and cooperation and include a wide range of possible reactions, which range from those having coercive power to supportive measures. In recent years, there has been increasing recognition of the need for sound regulatory frameworks for bioenergy. Faced with high petroleum and natural gas prices, and increasingly aware of climate change and environmental concerns, many countries are implementing national policies and legislation to encourage bioenergy production and use. These developments stem from the desire to achieve energy security and self-sufficiency, the need to reduce reliance on foreign fossil fuel reserves and the hope of providing increased trade opportunities for some agricultural commodities. Land use, and the competing needs of energy and food security are key issues in the bioenergy debate. International and national regulatory frameworks will have to establish clear guidelines for the sustainable development of the bioenergy industry. This paper aims to stimulate discussion on the elements of appropriate national legal frameworks for bioenergy, particularly in developing countries. It provides legislators and policy-makers with a tool to assist in identifying areas of law which may affect bioenergy regulation, and in designing key elements of national bioenergy laws.
