This volume follows the intentions of the Clausewitz-Society as described by one of its former presidents: “to view the current tasks of politics and strategy as reflected in the insights of Carl von Clausewitz and thus examine which of the principles and insights formulated by Clausewitz are still important today and are thus endowed with an enduring validity”. The board and the members of the Clausewitz-Society therefore supported the idea to examine how and when the works of Clausewitz have been interpreted in selected countries of our world; further, the goal here has been to analyze the role that Clausewitz’s thought still plays in these countries. This book is the paperback version of the 2011 published hardcover.

This book explores the history of the international order in the eighteenth and nineteenth century through a new study of Emer de Vattel’s Droit des gens (1758). Drawing on unpublished sources from European archives and libraries, the book offers an in-depth account of the reception of Vattel’s chief work. Vattel’s focus on the myth of good government became a strong argument for republicanism, the survival of small states, drafting constitutions and reform projects and fighting everyday battles for freedom in different geographical, linguistic and social contexts. The book complicates the picture of Vattel’s enduring success and usefulness, showing too how the work was published and translated to criticize and denounce the dangerousness of these ideas. In doing so, it opens up new avenues of research beyond histories of international law, political and economic thought.

This book is based on the observation that international law is undergoing a process of change and modernization, driven by many factors, among which the affirmation and consolidation of the role of the individual and of the theory of human rights stand out. In the contemporary world, international law has demonstrated an ability to evolve rapidly. But it is still unclear whether its modernization process is also producing structural changes, which affect the subjects, the sources and even the very purpose of this law. Is it truly possible to speak of a paradigmatic and ideological change in the international legal system, one that also involves a transition from a state-centred international order to a human-centred one, and from inter-state justice to global justice?The book addresses three fundamental aspects of the modernization process of international law: the possible widening of the concept of international community and of the classic assumptions of statehood; the possible diversification of the sources of general international law; and the ability of international law to adapt to new challenges and to achieve the main goals for humanity set by the United Nations.The overall objective of the book is to provide the tools for a deeper understanding of the transition phase of contemporary international law, by examining the major problems that characterize this phase.
