Focusing on femicide, this book provides a contemporary re-evaluation of Carol Smart’s innovative approach to the law question as first outlined in her ground-breaking book, Feminism and the Power of Law (Routledge 1989). Smart advocated turning to the legal domain not so much for demanding law reforms as construing it as a site on which to contest gender and more particularly, gendered constructions of women’s experiences. Over the last 30 to 40 years, feminist law scholars and activists have launched scathing trans-jurisdictional critiques of the operation of provocation defences in hundreds of femicide cases. The evidence unearthed by feminist scholars that these defences operate in profoundly sexed ways is unequivocal. Accordingly, femicide cases have become critically important sites for feminist engagement and intervention across numerous jurisdictions. This book discusses the phenomenon of femicide—the killing of women globally because of their gender—in peacetime and in war. Femicide in war is different from femicide in peace, and yet the dividing line between the two is thin. Violence against women happens in many forms—from emotional, psychological, and financial abuse, and barriers to personal autonomy, to physical and sexual abuse terminating in murder. It includes infanticide, sex selection, misogynistic laws and cultural practices and can include genital mutilation, forced sterilization, or forced pregnancy. Women experience these forms of violence during peacetime, as well as in times of crisis, conflict, or national insecurity. Increasingly there is global attention on the prevalence of women’s deaths resulting from intimate partner violence. Campaigns such as ‘Counting Dead Women’ in Australia, the ‘Femicide Census’ in England, the Canadian Femicide Observatory, and the emergence of family violence death review teams globally, build on the work of agencies such as the United Nations and the World Health Organisation, highlighting the fatal consequences of intimate partner violence for women around the world. This book considers the need for and the steps to be taken towards creating a meaningful framework for a global index of women’s deaths from intimate partner violence. While there are global indices for deaths that relate to public violence, such as terrorism, there is to date no systematic global count of killings of women by their intimate partners. It considers the possibilities and challenges that arise in counting intimate femicide. It argues that such an exercise needs to avoid narrow empiricism and instead be part of a broader feminist political project aimed at ending violence against women. This work will be of great interest to students and scholars of criminology, sociology, law, policing, and politics.

Can the way a word is used give legitimacy to a political movement? Feminism, Violence, and Representation in Modern Italy traces the use of the word "femminicidio" (or "femicide") as a tool to mobilize Italian feminists, particularly the Union of Women in Italy (UDI). Based on nearly two years of fieldwork among feminist activists, Giovanna Parmigiani takes a broad look at the many ways in which violence inflects the lives of women in Italy. From unchallenged gendered grammar rules to the representation of women as victims, Parmigiani examines the devaluing of women's contribution to their communities through the words and experiences of the women she interviews. She describes the first uses of the word "femminicidio" as a political term used by and within feminist circles and traces its spread to ultimate legitimization and national relevance. The word redefined women as a political subject by building an imagined community of potentially violated women. In doing so, it challenged Italians to consider the status of women in Italian society, and to make this status a matter of public debate. It also problematized the connection between women and tropes of women as objects of suffering and victimhood. Parmigiani considers this exchange within the context of Italian Catholic heritage, a precarious economy, and long-held notions of honor and shame. Parmigiani provides a careful and searing consideration of the ways in which representations of violence and the politics of this representation are shaping the future of women in Italy and beyond.
