The question whether and how boundaries might individuate and thereby be constitutive features of any imaginable legal order has yet to be addressed in a systematic and comprehensive manner by legal and political theory. This book seeks to address this important omission, providing an original contribution to the debate about law in a global setting. Against the widely endorsed assumption that we are now moving towards law without boundaries, it argues that every imaginable legal order, global or otherwise, is bounded in space, time, membership, and content. The book is built up around three main insights. Firstly, that legal orders can best be understood as a form of joint action in which authorities mediate and uphold who ought to do what, where, and when with a view to realising the normative point of acting together. Secondly, that behaviour can call into question the boundaries that determine who ought to do what, where and when: a-legality. Thirdly, that this a-legality reveals boundaries as marking a limit and, to a lesser or greater extent, a fault line of the respective legal order. Legal boundaries reveal ways of ordering the who, what, where, and when of behaviour which have been excluded, yet which remain within the range of practical possibilities accessible to the collective: limits. However legal boundaries also intimate an order which exceeds the range of possibilities accessible to that collective - the fault line of the respective legal order. Careful analysis of a wide range of legal orders, including nomadism, Roman law, classical international law, ius gentium, multinationals, cyberlaw, lex mercatoria, the EU, global regimes of human rights, and space law validates this thesis. What sense, then, can we make of the normativity of the law, if there can be no inclusion without exclusion? Arguing that legal and political theories misunderstand how legal boundaries do their work of including and excluding, the book develops a normative theory of legal order which is alternative to both communitarianism and cosmopolitanism.

This book deals with the causes, nature, and impact of the divisions within the jihadi movement, and the splits between jihadis and other Islamic groups. Fault Lines in Global Jihad offers a systematic and comprehensive examination of the broad range of divisions that contribute to the weakening of the jihadi movement. It separates these divisions into two broad categories, namely fissures dividing jihadis themselves, and divisions separating jihadis from other Muslim and Islamist groups. The first part of the book covers intra-jihadi divisions, highlighting tensions and divisions over strategic, tactical, and organizational issues. International law and armed conflict exist in a symbiotic relationship. In some cases, law shapes conflict proactively by imposing normative limits in advance of the appearance of proscribed conduct. Much more commonly, armed conflict either reveals lacunae in the law or demonstrates how law designed for yesterday’s wars falls short when applied to contemporary conflict. When that happens, international law reacts by allowing provisions to fall into desuetude, embracing new interpretations of existing prescriptions, or generating new norms through practice or codification. In the 21st Century, both international security and armed conflict are the subject of arguably unprecedented sea changes. As a result, claims that both the jus ad bellum and jus in bello are unwieldy and ill-fitting in the context of modern hostilities have surfaced prominently. This book focuses on the crises facing Al Qaeda and how the mass killing of Muslims is challenging its credibility as a leader among Islamist jihadist organizations. The book argues that these crises are directly related to Al Qaeda’s affiliation with the extreme violence employed against Muslims in Iraq, Syria, Afghanistan and Pakistan in the decade since 9/11. Al Qaeda’s public and private responses to this violence differ greatly. While in public Al Qaeda has justified those attacks declaring that, for the establishment of a state of ‘true believers’, they are a necessary evil, in private Al Qaeda has been advising its local affiliates to refrain from killing Muslims. To better understand the crises facing Al Qaeda, the book explores the development of Central Al Qaeda’s complex relationship with radical (mis)appropriations and manifestations of takfir, which allows one Muslim to declare another an unbeliever, and its unique relationship with each of its affiliates in Iraq, Syria, Afghanistan and Pakistan. The author then goes on to consider how the prominence of takfir is contributing to the deteriorating security in those countries and how this is affecting Al Qaeda’s credibility as an Islamist terror organization. The book concludes by considering the long-term viability of Al Qaeda and how its demise could allow the rise of the even more radical, violent Islamic State and the implications this has for the future security of the Middle East, North Africa and Central/South Asia.
