En varios temas sensibles, algunos delos cuales se abordan en este libro, la Jurisprudencia ha afirmado con fuerzaopiniones y conceptos que han sido objeto de modulación posterior o incluso deabierta corrección, como las condiciones de perfeccionamiento de los contratos,las consecuencias de las fallas de planeación, el significado y alcance de lasautorizacio­nes constitucionales para contratar o de la subsanación de ofertas,las consecuencias de la nulidad del contrato, la amplitud de las modificacionescontractuales, el cómputo de plazos de caducidad de acciones jurisdiccionalesen temas contractuales, las con­diciones de las distintas teorías que explicanel reequilibrio financiero del contrato y muchos otros más. Y, sin ernbarqo, en todos los eventos las decisiones delConsejo de Estado han de­finido temas contractuales sensibles, hasta el puntode dar lugar, en algunos casos, a definiciones legales según las concepcionesjurisprudenciales e incluso a regular legalmente temas tratados en decretos quehan desbordando la potestad reglamen­taria y por ello han sido anulados por elcontencioso administrativo. Así pues, estudiar la jurisprudencia y la doctrina oficialesemerge como una tarea no solo útil, sino indispensable, ineludible, para lograrla caracterización de la contra­tación pública. Ellas no solo definen elsentido y el alcance del derecho positivo fijado en la ley y el reglamento,sino también son motor inspirador del derecho positivo, indi­cándole a veces allegislador la vía técnica que ha de seguir. Incluso, la creciente glo­balizacióndel derecho, a la que es particularmente sensible la contratación pública,incita a una dinámica reforzada de influencia jurisprudencial, más allá delejercicio de comparación de regímenes jurídicos, por la pertinencia directa quepueden tener los fallos foráneos en nuestros problemas contractuales. Los autores de esta obra han identificado nuevefallos que constituyen referentes de análisis de los temas contractuales a losque se refieren. Más allá de un análisis de sentencias, los autores se apoyanen la importancia de los fallos para el entendimiento de los temascontractuales y la valoración de su repercusión, tanto en la jurisprudenciaposterior como en la regulación normativa y la mejor caracterización de las institucionescontractuales. Las contradicciones, así como la depuración de nociones o sucorrección y la estructuración de líneas jurisprudenciales, no son obstáculopara apreciar la impor­tancia de los fallos seleccionados, cuyo valor referenteilumina y orienta el mejor enten­dimiento y caracterización de los temascontractuales.

A region known for its volatility, Latin America and the Caribbean (LAC) has suffered severe economic and social setbacks from crises—including the COVID-19 pandemic. These crises have taken their toll on careers, wage growth, and productivity. Employment in Crisis: The Path to Better Jobs in a Post-COVID-19 Latin America provides new evidence on the effects of crises on the region’s workers and firms and suggests several policy responses that can bolster long-term and inclusive economic growth. This report has three key findings. First, crises lead to persistent employment losses and accelerate structural changes away from the formal sector. This change occurs more through reductions in the creation of formal jobs than through job destruction. Second, some workers recover from crises, while others are permanently scarred by them. Low-skilled workers can suffer up to a decade of lower earnings caused by crises, while high-skilled workers rebound fast, exacerbating the LAC region’s high level of inequality. Formal workers suffer smaller employment and wage losses in localities with higher rates of informality. And the reduced job flows caused by crises decrease welfare, but workers in localities with more job opportunities, whether formal or informal, bounce back better. Third, crises’ cleansing effects can increase efficiency and productivity, but these effects are dampened by the LAC region’s less competitive market structure. Rather than becoming more agile and productive during economic downturns, protected sectors and firms gain market share and crowd out others, trapping valuable resources. This report proposes a three-pronged mix of policies to improve the LAC region’s responses to crises: • Create a more stable macroeconomic environment to smooth the impacts of crises, including automatic stabilizers such as unemployment insurance and short-term compensation programs; • Increase the capacity of social protection and labor programs to respond to crises and coalesce these programs into systems that complement income support with reemployment assistance and reskilling opportunities; and • Tackle structural issues, including the lack of product market competition and the spatial dimension behind poor labor market adjustment—a “good jobs and good firms†? agenda.
