In international investment law, the prism of indirect expropriation includes a broad range of measures – such as regulatory measures – which do not involve a transfer of property but result in a serious interference with an investment. The definition of compensable taking is a very sensitive issue situated at the crossroads between the protection of investors' private rights and the safeguarding of the state's sovereign prerogatives. This book explores, through the example of environmental regulation, the law applicable to this controversial topic. It suggests that the traditional approach – based on an extension of the concept of expropriation – is inappropriate and it contributes to clarifying the scope of the international protection of the investor on the ground of the law of state responsibility.

Composing the Citizen
Author: Jann Pasler
Publisher: Univ of California Press
ISBN: 0520943872
Category : Music
Languages : en
Pages : 813
Book Description
In a book that challenges modernist ideas about the value and role of music in Western society, Composing the Citizen demonstrates how music can help forge a nation. Deftly exploring the history of Third Republic France, Jann Pasler shows how French people from all classes and political persuasions looked to music to revitalize the country after the turbulent crises of 1871. Embraced not as a luxury but for its "public utility," music became an object of public policy as integral to modern life as power and water, a way to teach critical judgment and inspire national pride. It helped people to forget the past, voice conflicting aspirations, and imagine a shared future. Based on a dazzling survey of archival material, Pasler's rich interdisciplinary work looks beyond elites and the histories their agendas have dominated to open new windows onto the musical tastes and practices of amateurs as well as professionals. A fascinating history of the period emerges, one rooted in political realities and the productive tensions between the political and the aesthetic. Highly evocative and deeply humanistic, Composing the Citizen ignites broad debates about music's role in democracy and its meaning in our lives.

Procedural Requirements for Administrative Limits to Property Rights
Author: Martina Conticelli
Publisher: Oxford University Press
ISBN: 0198867581
Category :
Languages : en
Pages : 401
Book Description
Through a comparative survey spanning twelve legal systems and a transnational regime, the fourth volume in this series aims to shed light on the core of administrative activity that exemplifies the 'negative State'. Within the vast field of adjudication, the book addresses one of the most traditional sets of procedures, namely, the exercise of public powers affecting property rights. Following the method adopted in the CoCEAL project, this volume takes the fundamentals of expropriation in a given legal order as its starting point and examines various cases. The main requirements for property rights deprivations and restrictions are presented through national reports and discussed through hypotheticals, while the comparative analysis focuses on procedural propriety and fairness. This book is divided into three parts. The first part introduces the project and the topic. The second part covers the legal systems chosen for this study. The third goes on to present a synchronic comparison across systems, highlighting the relationship between shared and distinctive traits, with a view to the way supranational and international rules increasingly supplement municipal regimes. The concluding chapter discusses the current regime on public regulation of property in contemporary administrative systems.
