Cuando hablamos del concepto de delito, estamos hablando de la esencia del Ius puniendi, para el análisis de este concepto que es lo que trata la presente obra, nos apoyamos en conceptos filosóficos y dogmaticos, de ahí la denominación del libro como Concepto Filosófico y Dogmatico del Delito. Al referirnos al concepto filosófico y dogmatico del delito, hacemos un esbozo del pensamiento filosófico, señalando que desde el punto de vista religioso el pecado se equipara al delito, en el cristianismo encontramos prohibiciones como no robar, no matar, hoy recogidas estos mandatos en tipos penales autónomos. Ya tratando de positivista el concepto de delito, desde la dogmatica, nos paseamos por el pensamiento Griego, Romano, hasta llegar a las escuelas positivistas alemanas, para terminar aceptando, que el delito es un acto típico antijurídico y culpable. Una vez definido el concepto de delito, desde la óptica filosófica y dogmatica, nos entramos en los elementos que lo componen, como son: la tipicidad, la acción, la culpabilidad como elemento punitivo.

The marriage of philosophy and fiction in the first third of Spain's twentieth century was a fertile one. It produced some truly notable offspring—novels that cross genre boundaries to find innovative forms, and treatises that fuse literature and philosophy in new ways. In her illuminating interdisciplinary study of Spanish fiction of the "Silver Age," Roberta Johnson places this important body of Spanish literature in context through a synthesis of social, literary, and philosophical history. Her examination of the work of Miguel de Unamuno, Pio Baroja, Azorin, Ramon Perez de Ayala, Juan Ramon Jimenez, Gabriel Miro, Pedro Salinas, Rosa Chacel, and Benjamin Jarnes brings to light philosophical frictions and debates and opens new interpersonal and intertextual perspectives on many of the period's most canonical novels. Johnson reformulates the traditional discussion of generations and "isms" by viewing the period as an intergenerational complex in which writers with similar philosophical and personal interests constituted dynamic groupings that interacted and constantly defined and redefined one another. This volume addresses an important historiographical gap by assessing the respective contributions of tradition and foreign influences to the 19th century codification of criminal law. More specifically, it focuses on the extent of French influence – among others – in European and American civil law jurisdictions. In this regard, the book seeks to dispel a number of myths concerning the French model’s actual influence on European and Latin American criminal codes. The impact of the Napoleonic criminal code on other jurisdictions was real, but the scope and extent of its influence were significantly less than has sometimes been claimed. The overemphasis on French influence on other civil law jurisdictions is partly due to a fundamental assumption that modern criminal codes constituted a break with the past. The question as to whether they truly broke with the past or were merely a degree of reform touches on a difficult issue, namely, the dichotomy between tradition and foreign influences in the codification of criminal law. Scholarship has unfairly ignored this important subject, an oversight that this book remedies.
