Updated as of May 29, 2018 We (NMFS and USFWS; also collectively referred to as the Services) have determined that the loggerhead sea turtle (Caretta caretta) is composed of nine distinct population segments (DPSs) that constitute "species" that may be listed as threatened or endangered under the Endangered Species Act (ESA). Updated as of May 29, 2018 We, the National Marine Fisheries Service (NMFS), issue a final rule to designate critical habitat for the Northwest Atlantic Ocean Distinct Population Segment (DPS) of the loggerhead sea turtle (Caretta caretta) within the Atlantic Ocean and the Gulf of Mexico pursuant to the Endangered Species Act of 1973, as amended (ESA). Specific areas for designation include 38 occupied marine areas within the range of the Northwest Atlantic Ocean DPS. These areas contain one or a combination of habitat types: Nearshore reproductive habitat, winter area, breeding areas, constricted migratory corridors, and/or Sargassum habitat. The U.S. Fish and Wildlife Service (USFWS) is issuing a final rule for loggerhead critical habitat for terrestrial areas (nesting beaches) in a separate document. No marine areas meeting the definition of critical habitat were identified within the jurisdiction of the United States for the North Pacific Ocean DPS, and therefore we are not designating critical habitat for that DPS. Updated as of May 29, 2018 NMFS and USFWS issue a final rule to list 11 distinct population segments (DPSs) of the green sea turtle (Chelonia mydas; hereafter referred to as the green turtle) under the Endangered Species Act (ESA). Based on the best available scientific and commercial data, and after considering comments on the proposed rule, we have determined that three DPSs are endangered species and eight DPSs are threatened species. This rule supersedes the 1978 final listing rule for green turtles. It applies the existing protective regulations to the DPSs. Critical habitat is not determinable at this time but will be proposed in a future rulemaking. In the interim, the existing critical habitat designation (i.e., waters surrounding Culebra Island, Puerto Rico) remains in effect for the North Atlantic DPS. All six species of sea turtles found in U.S. waters are listed as endangered or threatened, but the exact population sizes of these species are unknown due to a lack of key information regarding birth and survival rates. The U.S. Endangered Species Act prohibits the hunting of sea turtles and reduces incidental losses from activities such as shrimp trawling and development on beaches used for nesting. However, current monitoring does not provide enough information on sea turtle populations to evaluate the effectiveness of these protective measures. Sea Turtle Status and Trends reviews current methods for assessing sea turtle populations and finds that although counts of sea turtles are essential, more detailed information on sea turtle biology, such as survival rates and breeding patterns, is needed to predict and understand changes in populations in order to develop successful management and conservation plans.
