Book Description
Excerpt from Employers Liability for Personal Injuries to Their Employees The legislature at its last session directed an investigation of the subject of the liability of employers to workmen for injuries received while in the discharge of their duty, and a consideration of what changes, if any, are needed in the existing laws relative to such liability. A careful investiga tion of the law and facts which bear upon the subject has been made, and it has been fully considered in its various phases, with especial care, for the first time, so far as known in this country. It is a subject which, in all its varied relationships, is by no means easy of comprehension. It is fruitful of embarrassments. And hedged about with difficul ties, but at the same time of no inconsiderable consequence to the welfare of the community. During the nine years ending with 1881 there were, according to the Railroad Gazette, persons killed, and injured, in the United States, on the railroads alone; and of these, were killed and injured on the railroads of this Com mon wealth. A large majority of both the killed and injured were employees. Of those killed in this Commonwealth, 358 were of this class, while of those injured there were (553. During the year 1881 alone, 72 employees were killed and 128 injured in this Commonwealth. \vhen one single branch of employment causes such an annual sacrifice as this, it seems to be time to consider whether something cannot be done to prevent it. Book Description
This large-scale comparative study analyses the two principal mechanisms employed in modern legal systems to deal with the social problem of occupational illness and injury, namely, employers' liability and workers' compensation. It provides a detailed description of the systems in operation in twelve countries around the world, investigating the complex legal structures and the interaction with other social institutions, as well as their inter-jurisdictional coordination through private international law. Current international trends are identified and assessed and the fundamental political issues highlighted and explored. The study's ultimate goals are not only descriptive but also to answer the question of how compensation and liability systems can best be adapted to meet society's needs in the 21st century. The countries covered are: Australia (Mark Lunney), Austria (Ernst Karner/Felix Kernbichler), Denmark (Vibe Ulfbeck), England and Wales (Richard Lewis), France (Florence G'Sell/Isabelle Veillard), Germany (Raimund Waltermann), Italy (Alessandro P Scarso/Massimo Foglia), Japan (Keizo Yamamoto/Tomohiro Yoshimasa), the Netherlands (Siewert D Lindenbergh), Poland (Domenika Dörre-Nowak), Romania (Christian Alunaru/Lucian Bojin) and the United States of America (Michael D Green/Daniel S Murdock). The book is completed by three concluding essays that address general themes: Thomas Thiede, The European Coordination of Employers' Liability and Workers' Compensation Ken Oliphant, The Changing Landscape of Work Injury Claims: Challenges for Employers' Liability and Workers' Compensation Gerhard Wagner, New Perspectives on Employers' Liability - Basic Policy Issues

Book Description
Knowledge about the application of law to maritime commerce not only may prove financially profitable but also provides an exciting intellectual trip through the historical and legal developments behind commercial activities that depend upon the sea. This work analyzes the growth and formation of maritime law across the centuries, including its origin as England s admiralty law and its adoption into the United States Constitution. It sets out information on the jurisdiction and law appropriate for the carriage of goods by sea, personal injuries and death collisions, salvage and wrecks, marine insurance, and marine pollution. Lawyers, professors, and students of law and anyone involved in marine transportation - carriers, shippers, port managers, freight forwarders, and others - will appreciate this book's succinct and readable style. It includes references to statutes, conventions, and cases - including some historical and social background to enliven and clarify the development of admiralty and maritime law in the United States.
