En este libro se ofrece un estudio de la regulación internacional de los recursos hídricos compartidos, tanto por el Derecho de los Cursos de Agua Internacionales tradicional como de sus desarrollos más recientes, procedentes del Derecho Internacional del Medio Ambiente, el Derecho Internacional Económico o el Derecho Internacional de los Derechos Humanos, y, de forma especial, el incipiente régimen jurídico de los acuíferos transfronterizos. Además, se analiza cómo se han plasmado en esta regulación la soberanía y la cooperación. Por un lado, los Estados ejercen su soberanía sobre el agua que se encuentra en su territorio, a pesar del encaje imperfecto que pueda tener sobre un recurso fluido, en constante movimiento y transformación a través del ciclo hidrológico y que no conoce de fronteras. Además, presenta particularidades en relación con los acuíferos, sobre todo, debido a la existencia de una formación geológica contenedora de las aguas subterráneas. Por otro, la cooperación sobre los recursos hídricos compartidos es consustancial a la propia historia de su regulación y cuenta con una multiplicidad de manifestaciones a nivel interestatal, regional y universal, predominando sobre las muestras de conflicto. No obstante, la dimensión global de los recursos hídricos y de los problemas a los que tienen que hacer frente pone de manifiesto las limitaciones de los enfoques puramente interestatales en su ordenación y han provocado, incluso, el surgimiento de tendencias internacionalizadoras sobre los mismos. Tendencias que, paradójicamente, conviven con intentos de reforzamiento de los derechos soberanos de los Estados sobre los recursos hídricos situados en su territorio.
