Collectively known as “drones,” they were initially deployed for military purposes: reconnaissance, surveillance and extrajudicial executions. Today, we are witnessing a growth of their use into the civilian and humanitarian domain. They are increasingly used for goals as diverse as news gathering, aerial inspection of oil refinery flare stacks, mapping of the Amazonian rain-forest, crop spraying and search and rescue operations. The civil use of drones is becoming a reality in the European Union and in the US.The drone revolution may be a new technological revolution. Proliferation of the next generation of “recreational” drones show how drones will be sold as any other consumer item. The cultural perception of the technology is shifting, as drones are increasingly being used for humanitarian activities, on one hand, but they can also firmly be situated in the prevailing modes of postmodern governance on the other hand. This work will be of interest to researchers in Criminology and Criminal Justice interested in issues related to surveillance, security, privacy, and technology. The looming prospect of expanded use of unmanned aerial vehicles, colloquially known as drones, has raised understandable concerns for lawmakers. Those concerns have led some to call for legislation mandating that nearly all uses of drones be prohibited unless the government has first obtained a warrant. Privacy advocates have mounted a lobbying campaign that has succeeded in convincing thirteen states to enact laws regulating the use of drones by law enforcement, with eleven of those thirteen states requiring a warrant before the government may use a drone. The campaigns mounted by privacy advocates oftentimes make a compelling case about the threat of pervasive surveillance, but the legislation is rarely tailored in such a way to prevent the harm that advocates fear. In fact, in every state where legislation was passed, the new laws are focused on the technology (drones) not the harm (pervasive surveillance). In many cases, this technology centric approach creates perverse results, allowing the use of extremely sophisticated pervasive surveillance technologies from manned aircraft, while disallowing benign uses of drones for mundane tasks like accident and crime scene documentation, or monitoring of industrial pollution and other environmental harms.

Unmanned aircraft systems (UAS, also known as drones) are being increasingly more utilized in domestic law enforcement operations, enabling officers to maximize situational awareness from overhead while minimizing their exposure to danger. As the domestic airspace is scheduled to be fully drone integrated by 2015, growing concerns over national security and privacy issues have highlighted the capabilities and potential implications of using UAS on a national scale. This book examines the potential effectiveness of utilizing domestic aerial surveillance to increase homeland security while addressing how, and to what level, these programs should be federally overseen and regulated without infringing on Americans' civil liberties. This book argues that large-scale UAS operations by federal agencies are cost-inefficient and lack tangible results, while state and local agency operations, which employ smaller systems in more specific situations, are less expensive and more effective. Current U.S. law allows for aerial surveillance by law enforcement, but updating privacy legislation to account for modern technology should be considered. The Department of Homeland Security (DHS) needs to accelerate its working relationship with the Federal Aviation Administration (FAA) and its UAS approval process to establish and maintain privacy safeguards to ensure the highest level of national security while minimizing civil liberty infringement.
