Labour Law Utopias: Post-Growth & Post-Productive Work Approaches engages with new socioeconomic ideas that look beyond the current growth-driven competitive market economy. Building on analysis of economic growth, as well as the limits of the logic of human productivity and competitivity for workers and the environment, it explores alternative approaches and what those will mean for work in general, and labour law in particular. The concept of 'post-growth' is used to rethink the purpose of the economy by looking beyond merely increasing wealth, consumption, and production, considering what this means for the position of work in society as well as the individual worker. The post-productive work approach is used to question the centrality of economically productive work and its regulation in labour laws. Welfare-to-work or activation policies refer to programmes aimed at promoting the employability, labour-market and social participation of benefit recipients of working age. Frontline workers delivering these policies are conceived of as policy implementers, as policy makers, and as actors mediating politics in an arena where conflicting interests are at stake. Frontline work plays a crucial role in determining what welfare-to-work practically means and how it affects the lives of the people it targets. Yet few books have deliberatively focused on comparing what happens when frontline workers, some of whom are professional social workers, meet clients. Pioneering the provision of scholarly reflections on both theoretical and policy relevance of studying frontline practices of delivering activation, internationally renowned researchers present the first comparative analysis of how activation policies are actually delivered by frontline staff in selected EU countries and in the United States. On observe une tendance lourde au renforcement des obligations liées au travail, pouvant aller jusqu'à l'instauration de programmes de travail obligatoires. L'activation peut également passer par le développement d'aides à la recherche d'emploi, de formations ou de stages professionnels. L'ouvrage propose une analyse inédite de l'ensemble de ces mesures sous le prisme des droits humains, plus particulièrement du droit au travail. Ces mesures favorisent-elles la réalisation du droit au travail ou constituent-elles une restriction à la liberté de choisir son emploi ? Pour répondre à cette question, l'auteure procède à une analyse systématique et rigoureuse de la jurisprudence internationale relative au droit au travail. Ce corpus jurisprudentiel, rarement exploité et peu connu des praticiens, se révèle particulièrement fécond, notamment parce que le droit au travail comprend le libre choix de l'emploi et l'interdiction du travail forcé. One of the principal tasks for legal research at the beginning of the 21st century is to reconstruct the understanding of the relationship between the legal system and the market order. After almost three decades of deregulation driven by a belief in the self-equilibrating properties of the market, the financial crisis of 2008 has reminded everyone of the fundamental truth that markets have legal and institutional foundations, without which they cannot effectively function. The chapters in the present volume are the result of work by a group of legal scholars which began in the mid-2000s, at a time when the shortcomings of deregulatory policies were becoming clear in a number of contexts. The chapters address the question of how the language of contract law describes or conceptualises the market order and the relationship of the law to it. The perspectives taken are, in turn, historical, comparative, and context-specific. The focus of the book is on a foundational idea, the concept of capacitas, which signifies a status conferred upon citizens for the purpose of enabling them to participate in the economic life of the polity. In modern legal systems, 'capacity' is the principal juridical mechanism by which individuals and entities are empowered to enter into legally binding agreements and, more generally, to arrange their affairs using the instruments of private law. Legal capacity is thereby the gateway to involvement in the operations of a market economy.
