This book illustrates how Africa’s defence and security domains have been radically altered by drastic changes in world politics and local ramifications. First, the contributions of numerous authors highlight the transnational dimensions of counterterrorism and counterinsurgency in Africa and reveal the roles played by African states and regional organisations in the global war on terror. The objective of this work is to provide an analysis of the legislative approaches to counter-terrorism and human rights in Australia, Canada, New Zealand and the United Kingdom. The text is aimed at lawyers and practitioners within and outside common law nations. Although the text analyses the subject within the four jurisdictions named, many parts of the book will be of interest and relevance to those from outside those jurisdictions. Considerable weight is placed on inter- tional obligations and directions, with a unique and hopefully useful feature of the text being the inclusion and consideration of a handbook written by me on human rights compliance when countering terrorism (set out in Appendix 4 and considered in Chap. 13). A signi?cant part of the research undertaken for this work was as a result of my being awarded the International Research Fellowship, Te Karahipi Rangahau a Taiao, an annual fellowship generously funded by the New Zealand Law Foun- tion. Over the last thirty years, the UN has shown an unmistakable interest in combating terrorism. This book analyses the practice of the General Assembly and the Security Council in combating terrorism. It answers the question whether these organs, taking into account their powers and the constitutional and public international law limitations thereof, best contribute to a universal anti-terrorism policy. In order to assess whether both organs are indeed fulfilling this purpose, the analysis of the adopted counter-terrorism measures of both the General Assembly and the Security Council focuses on their legality and legitimacy. Whereas the measures adopted should clearly fall within the powers of the organs (legality), testing the legitimacy of these measures adds another layer of information with regard to the quality of these measures. The analysis of the legitimacy of the anti-terrorism measures is based on the theory of Thomas Franck, who claims that a rule¿s legitimacy provides information on the pull to compliance of the measure. Apart from this critical analysis of the legality and the legitimacy of more than 130 resolutions adopted by both UN organs, this book offers an essential insight in the way the degree of legitimacy of certain measures can be improved, and how the overall effectiveness of the counter-terrorism policy of the UN can be strengthened.

After twenty-five years of independence, there is little doubt that the five Central Asian states will persist as sovereign, independent states. They increasingly differ from each other, and are making their way in global politics. No longer connected only to Russia, they are now connected in important ways to Afghanistan, South Asia, China, Iran, and each other. This volume covers a wide range of issues and presents the work of emerging scholars authors well-known for their expertise in the region. The first part addresses social issues. Covering a wide range from HIV/AIDs to social media, the rebirth of Islam, outmigration, and problematic borders, this section follows two main currents: political development in the region and states’ responses to transboundary challenges. The second part, addressing economics and security, provides analyses of new infrastructure, informal economies (from bazaars to criminal networks), energy development, the role of enclaves in the Ferghana Valley, and the development of the states’ military structures. This section illuminates the interactions between economic developments and security, and the forces that could undermine both. The final part, comprised of five case studies, offers a “deeper dive” into a specific factor that matters in the development of each Central Asian state.
