This books provides an in-depth analysis of the international legal aspects of the use of depleted uranium (DU) ammunition and armour. The military use of DU has been surrounded by considerable controversy, mainly as regards the health and environmental risks that such use entails. The debate about DU has thus far been highly polarised, with one end of the spectrum rejecting any risk whatsoever and the other end suggesting that the use of DU leads to severe health and environmental consequences, including Gulf-War syndrome, whenever it is used. Rather than settling these controversies, the book takes as a starting point a precautionary approach in light of the considerable remaining scientific uncertainties. It examines various principles and rules of international law, which would be at play if the health and environmental concerns regarding the use of DU were to materialise.

In the recent past the horrors of war have been demonstrated all too vividly. Who would have believed that after Nuremberg there would be any further need for war crimes tribunals, or for the creation of an international criminal court? But, whilst people in conflict countries suffer the mental and physical scars from military bombardment, they also suffer the silent legacy of environmental pollution. The world functions as one large ecosystem: the contamination of one element inevitably feeding into another. Pollution in peacetime has been greatly reduced, but what is the wartime cost to the environment? Wartime weaponry and tactics are strictly controlled by the principles of humanitarian law, but international law can be a slow creature. Are our militaries using weapons today that violate the current laws of armed conflict? Or need new controls be drafted to deal with the environmental, and inevitably human, consequences of modern warfare? The book seeks to analyse the issues surrounding the protection of the environment in times of armed conflict, and to pose questions as to its adequacy and efficacy. There exists an ongoing debate regarding the legality of the continued use of munitions containing Depleted Uranium (DU). While there have been moratoriums placed upon its use by various members of the international community, widespread prohibition has not yet reached the level of international custom. While DU has been proven to be toxic in high doses, existing evidence suggests that the use of DU munitions will rarely reach levels that are unsafe. Because of this, it is unlikely that prohibitions on environmental modification enumerated within International Environmental Law or binding obligations currently in effect under International Human Rights Law would prohibit the continued use of DU. No existing legal instrument explicitly prohibits DU use and it is not legally appropriate to apply a comparison by analogy between DU and those weapons that are currently prohibited. Further, proposed alternatives to DU munitions are less effective and more toxic and therefore do not meet the thresholds of Military Necessity and Proportionality. There is the possibility that an argument exists under the Martens Clause: that DU containing weapons could be prohibited because they contrast starkly with public opinion, however, international juridical bodies do not generally enforce a prohibition on these grounds alone.
