Une personne est traduite au tribunal de commerce, en exé cution d'un acte, qu'on prétend, d'après les règles expliquées n°' 48 et suivants, ètre commercial, à cause de la qualité de commerçant qu'on attribue à cette personne, mais qu'elle dénie. Puisque cette personne est libre de faire des actes de commerce par sa seule volonté, le tribunal de commerce est compétent pour juger si elle en a fait un assez grand nombre pour ètre réputée commercante, suivant les règles données n° 79; et nous verrons au titre suivant comment cette preuve doit ètre faite. Mais lorsqu'il s'agit d'un mineur qu'on pré tend commercant, lorsqu'on soutient que telle personne du sexe n'est pas en puissance de mari il faut renvoyer au tri bunal civil pour juger ces questions. Si néanmoins une femme, assignée en qualité de commerçante, n'était pas as sistée de son mari ou par lui autorisée à ester en jugement, le tribunal de commerce serait compétent pour donner cette autorisation, dont le but unique est d'assurer la prompte et régulière décision du procès, et non de prononcer sur l'état de cette femme Mais il ne serait pas compétent pour lui donner l'autorisation nécessaire à l'introduction de l'instance.
