The Coalition Provisional Authority, Office of the Inspector General (CPA-IG), pursuant to Public Law 108-106, "The Emergency Supplemental Appropriations Act for the Defense and Reconstruction of Iraq and Afghanistan," November 6, 2003, is conducting a series of reviews related to the contracts awarded in support of the Iraq relief and reconstruction efforts. The review of corporate governance is an element of the CPA-IG efforts to deter and detect any fraud, waste, and abuse within the Iraq reconstruction efforts. We judgmentally selected five contractors performing work in Iraq for our audit of corporate governance programs. As part of the CPA-IG efforts to deter and detect any fraud, waste, and abuse within the Iraq reconstruction efforts, this audit directly reviewed corporate governance programs. Future audits will include an assessment of corporate governance programs in the audit scope once a particular review identifies weaknesses in corporate internal controls. Public Law 108-106 authorized $18.4 billion for security, relief, rehabilitation, and reconstruction in Iraq. The Project and Contracting Office manages all activities associated with program, project, asset, construction, and financial management of the reconstruction efforts undertaken by the United States. The Project and Contracting Office established six sectors for the reconstruction effort: Building/Education/Health, Communications/Transportation, Electrical, Oil, Public Works/Water, and Security/Justice.

SIGIR has often been asked about problems in the U.S. reconstruction program, including the extent to which contracts have been terminated because of poor performance on the part of the contractor. Government contracts generally contain clauses allowing the U.S. government to end a contract when the need for the supplies or services no longer exists, the contractor's performance becomes unsatisfactory, or some other situation develops that warrants contract closure. This follow-on report provides insights on factors and circumstances related to contract terminations of selected projects and the reasons for them. SIGIR's reporting objectives include determining (1) the numbers, types, and basis for all DoD terminations of Iraq reconstruction projects, and the characteristics of selected termination actions; (2) if terminated projects resulted in wasted government resources; (3) actions DoD agencies took against poor performing contractors; and (4) whether funds were still obligated against terminated projects. SIGIR recommends actions to reinforce the importance of screening contractors against lists of those debarred or suspended from receiving contracts, and deobligate excess funds that remain obligated against terminated contracts.

The Department of Defense (DOD) has relied extensively on contractors to undertake major reconstruction projects and provide support to its deployed forces, but these efforts have not always achieved desired outcomes. Further, the Iraqi government must be able to reduce violence, sustain reconstruction progress, improve basic services, and make a positive difference in the daily lives of the Iraqi people. This statement discusses (1) factors affecting DOD's ability to promote successful acquisition outcomes on its contracts for reconstruction and for support to deployed forces in Iraq, (2) the deteriorating security situation and the capabilities of the Iraqi security forces, and (3) issues affecting the Iraqi government's ability to support and sustain future reconstruction progress. The testimony is based upon our work on Iraq reconstruction and stabilization efforts, DOD contracting activities, and DOD's use of support contractors spanning several years. This work was conducted in accordance with generally accepted government auditing standards.
