Since the US Constitution came into force in 1789, it has been amended just twenty-seven times, with ten of those amendments coming in the first two years following ratification. By contrast, state constitutions have been completely rewritten on a regular basis, and the current documents have been amended on average 150 times. This is because federal amendments are difficult, so politicians rarely focus on enacting them. Rather, they work to secure favorable congressional statutes or Supreme Court decisions. By contrast, the relative ease of state amendment processes makes them a realistic and regular vehicle for seeking change. With State Constitutional Politics, John Dinan looks at the various occasions in American history when state constitutional amendments have served as instruments of governance. Among other things, amendments have constrained state officials in the way they levy taxes and spend money; enacted policies unattainable through legislation on issues ranging from minimum wage to the regulation of marijuana; and updated understandings of rights, including religious liberty, equal protection, and the right to bear arms. In addition to comprehensively chronicling the ways amendments shape politics in the states, Dinan also assesses the consequences of undertaking changes in governance through amendments rather than legislation or litigation. For various reasons, including the greater stability and legitimacy of changes achieved through the amendment process, he argues that it might be a more desirable way of achieving change.

American Indian nations are sovereign political entities within the United States. They have complex relationships with the federal government and increasingly with state governments. Regulatory conflict between Native nations and states has increased as Native nations have developed their own independent economies and some states have sought to assert their control over reservation territory. This book explores the intergovernmental conflict between Native nations and states, with a focus on the tension over the enforcement of state cigarette taxes for on-reservation sales. Anne F. Boxberger Flaherty asks: when do states and Native nations come to agreement, when do they disagree, and why are states sometimes willing to extend great efforts to assert their taxes on reservations? In Fifty Years from the Basement to the Second Floor, Tom Colbert, former chief of justice of the Oklahoma Supreme Court, shares his extraordinary life story—a story of resilience, determination, and hope. From his great-great grandmother who, though born into slavery, lived to be over 100 years old to his great grandfather who fought to be enrolled as a member of Creek Tribal Nation to his grandfather who walked over a mile home after being shot in the chest, never giving up no matter how hard the journey was instilled into Tom at a very young age. Born on December 30, 1949, Tom was raised by his mother and grandparents in Sapulpa, Oklahoma, when segregation laws were in effect. In fact, a few days after Tom was born, Ada Lois Sipuel Fisher had just started her second semester as a law student at the University of Oklahoma Law School after fighting for three years to be admitted there, refusing to attend the makeshift “Black-only” law school set up in the basement of the State Capitol. Though racial segregation was deemed unconstitutional in 1954, integration was intentionally delayed in Tom’s town, and he didn’t attend an integrated school until the fall of 1965. Although some teachers at his high school were welcoming, many staff and students were not, and Tom and his friends experienced racism, bigotry, and hatred, despite being star athletes and diligent students. Though he grew up in poverty and a world entrenched in systemic racism as well as dealt with family tragedies, Tom beat impossible odds, proving the naysayers of his youth wrong. He not only worked hard and became an outstanding lawyer, but reached the pinnacle of judiciary—and became the first Black man in Oklahoma to do so. Just like Ada Lois Sipuel Fisher, Tom refused the “basement,” and that noble resistance led him all the way to the second floor of the Oklahoma State Capitol.
