La Constitución española consagra la competencia exclusiva del Estado sobre la legislación de propiedad intelectual. Los estatutos de autonomía, por su parte, regulan la ejecución normativa sobre esta materia en el ámbito jurídico-público en virtud de las competencias transferidas. Esta dualidad de instancias generadoras de normas jurídicas suscita la cuestión de conocer el alcance de estos ámbitos competenciales y analizar las posibles colisiones y conflictos que pueden aflorar en la práctica en lo relativo a la interpretación y ejecución de la normativa sobre derecho de autor. Para un adecuado análisis y resolución de los problemas que puedan suscitarse en cuanto a la distribución de competencias, el autor sienta las bases de dos cuestiones claves: el significado que ha de darse a la expresión propiedad intelectual y, sobre todo, lo que hemos de entender por legislación. Desveladas estas premisas, la obra afronta con rigor crítico el estudio de las diferentes competencias estatales y autonómicas a fin de procurar siempre la tutela más apropiada de los derechos de propiedad intelectual, teniendo en cuenta el carácter unificador que la competencia exclusiva del Estado conlleva.
