Book Description
Choice Outstanding Academic Title for 2008 The U.S. Supreme Court has decided that states may require parental involvement in the abortion decisions of pregnant minors as long as minors have the opportunity to petition for a &#“bypass” of parental involvement. To date, virtually all of the 34 states that mandate parental involvement have put judges in charge of the bypass process. Individual judges are thereby responsible for deciding whether or not the minor has a legitimate basis to seek an abortion absent parental participation. In this revealing and disturbing book, Helena Silverstein presents a detailed picture of how the bypass process actually functions. Silverstein led a team of researchers who surveyed more than 200 courts designated to handle bypass cases in three states. Her research shows indisputably that laws are being routinely ignored and, when enforced, interpreted by judges in widely divergent ways. In fact, she finds audacious acts of judicial discretion, in which judges structure bypass proceedings in a shameless and calculated effort to communicate their religious and political views and to persuade minors to carry their pregnancies to term. Her investigations uncover judicial mandates that minors receive pro-life counseling from evangelical Christian ministries, as well as the practice of appointing attorneys to represent the interests of unborn children at bypass hearings. Girls on the Stand convincingly demonstrates that safeguards promised by parental involvement laws do not exist in practice and that a legal process designed to help young women make informed decisions instead victimizes them. In making this case, the book casts doubt not only on the structure of parental involvement mandates but also on the naïve faith in law that sustains them. It consciously contributes to a growing body of books aimed at debunking the popular myth that, in the land of the free, there is equal justice for all.

Book Description
Civil Appellate Practice in the Minnesota Court of Appeals is a comprehensive practitioner's guide to civil appellate practice and procedure in the Minnesota Court of Appeals. Rules, case law, and practical considerations that bear on practice in the Minnesota Court of Appeals are the book's primary concern. Decisions by the Minnesota Supreme Court that bear on practice in the intermediate court, or that are of general applicability, are included as well. The book begins with a brief description of the history and organization of the court of appeals. It then proceeds to take the reader through the various steps encountered in the prosecution of a case through the intermediate appellate court. Areas covered include jurisdiction; the initiation of appellate proceedings, including appealable judgments and orders, the effect of an appeal on remaining trial court proceedings, the procedure for appeal by multiple parties, the scope of review on appeal from a judgment or order, the time within which an appeal must be taken, and the manner in which an appeal must be perfected; the procedure involved in obtaining a writ of mandamus or prohibition; preargument motion practice; the record on appeal; the preparation of briefs and appendixes; oral argument; and postdecision procedures.

Book Description
Where do you turn when you are wrestling with a painful decision? You turn to your spouse, trusted friends and relatives, to professionals, to religious advisers. But sometimes you want accurate information and suggestions all in one place, in a form you can use on your own. The decision to have an abortion is not an easy one, and it is not the right decision for every pregnant woman, even in difficult circumstances. Every situation is different. Women considering abortion range in age from nine to fifty-five years. They are rich and poor; married and unmarried; white, black, brown, yellow, and red; members of every religious group and ethnic origin; heterosexual and homosexual. Some have no one to talk to and others have too many people talking to them. Some are in danger from physical, sexual, and emotional abuse. Abortion: Facts and Feelings is for women who are considering whether to have an abortion, women who have had an abortion and want to do more thinking about it, and relatives, mates, lovers, friends, and health professionals who want to help the women they care for make the best possible choices for themselves. Partners in relationships, families, and friends, and, of course, pregnant women themselves, deserve to have accurate information about this common, but controversial, procedure -- information they can use to make both personal and policy decisions. This book contains that information. It discusses * The practice of abortion in other times and places, and practical information about how it is practiced now* How to find out about abortion laws where you live, and laws in other places where you might go if necessary* The attitudes of major North American religious groups about abortion, and how to obtain more specific information about the approaches of your religion to your situation* The medical and psychological outcomes of abortion* Alternatives to abortion -- delivering the baby and either caring for it yourself or allowing someone else to provide the parenting* The needs and concerns of women in special circumstances, and of women's loved ones Most important, it will help you think through and carry out your own decision, whatever it is.
