Despite -- and perhaps because of -- increasing global mobility, there are more types of borders today than ever before in history. Borders of all kinds define every aspect of social life in the twenty-first century. From the biometric data that divides the smallest aspects of our bodies to the aerial drones that patrol the immense expanse of our domestic and international airspace, we are defined by borders. They can no longer simply be understood as the geographical divisions between nation-states. Today, their form and function has become too complex, too hybrid. What we need now is a theory of the border that can make sense of this hybridity across multiple domains of social life. Rather than viewing borders as the result or outcome of pre-established social entities like states, Thomas Nail reinterprets social history from the perspective of the continual and constitutive movement of the borders that organize and divide society in the first place. Societies and states are the products of bordering, Nail argues, not the other way around. Applying his original movement-oriented theoretical framework "kinopolitics" to several major historical border regimes (fences, walls, cells, and checkpoints), Theory of the Border pioneers a new methodology of "critical limology," that provides fresh tools for the analysis of contemporary border politics.

The U.S. Department of Homeland Security (DHS) is responsible for securing and managing the nation's borders. Over the past decade, DHS has dramatically stepped up its enforcement efforts at the U.S.-Mexico border, increasing the number of U.S. Border patrol (USBP) agents, expanding the deployment of technological assets, and implementing a variety of "consequence programs" intended to deter illegal immigration. During this same period, there has also been a sharp decline in the number of unauthorized migrants apprehended at the border. Trends in total apprehensions do not, however, by themselves speak to the effectiveness of DHS's investments in immigration enforcement. In particular, to evaluate whether heightened enforcement efforts have contributed to reducing the flow of undocumented migrants, it is critical to estimate the number of border-crossing attempts during the same period for which apprehensions data are available. With these issues in mind, DHS charged the National Research Council (NRC) with providing guidance on the use of surveys and other methodologies to estimate the number of unauthorized crossings at the U.S.-Mexico border, preferably by geographic region and on a quarterly basis. Options for Estimating Illegal Entries at the U.S.-Mexico Border focuses on Mexican migrants since Mexican nationals account for the vast majority (around 90 percent) of attempted unauthorized border crossings across the U.S.-Mexico border.

Border security has been high on public-policy agendas in Europe and North America since the September 11, 2001 attacks on the World Trade Centre in New York City and on the headquarters of the American military in Washington DC. Governments are now confronted with managing secure borders, a policy objective that in this era of increased free trade and globalization must compete with intense cross-border flows of people and goods. Border-security policies must enable security personnel to identify, or filter out, dangerous individuals and substances from among the millions of travelers and tons of goods that cross borders daily, particularly in large cross-border urban regions. This book addresses this gap between security needs and an understanding of borders and borderlands. Specifically, the chapters in this volume ask policy-makers to recognize that two fundamental elements define borders and borderlands: first, human activities (the agency and agent power of individual ties and forces spanning a border), and second, the broader social processes that frame individual action, such as market forces, government activities (law, regulations, and policies), and the regional culture and politics of a borderland. Borders emerge as the historically and geographically variable expression of human ties exercised within social structures of varying force and influence, and it is the interplay and interdependence between people's incentives to act and the surrounding structures (i.e. constructed social processes that contain and constrain individual action) that determine the effectiveness of border security policies. This book argues that the nature of borders is to be porous, which is a problem for security policy makers. It shows that when for economic, cultural, or political reasons human activities increase across a border and borderland, governments need to increase cooperation and collaboration with regard to security policies, if only to avoid implementing mismatched security policies.

Governing Cross-Border Data Flows explores how the European Union can simultaneously reconcile and pursue two important legal and policy objectives, namely: protecting fundamental rights guaranteed under the EU Charter of Fundamental Rights (EU Charter) concerning privacy and personal data, while also maintaining and developing a binding, rules-based global trading system to ensure appropriate access to foreign digital markets for EU businesses. The book demonstrates a significant conflict between international trade law and European data privacy law when it comes to the governance of cross-border flows of personal data. To resolve the tensions caused by this clash, the book proposes concrete and detailed ways to ameliorate the situation from both ends (international trade and personal data protection), specifically through reforms of both international trade and chapter V of the General Data Protection Regulation (GDPR). To explain how such reforms could be effectuated, Yakovleva examines the role of discourse in the evolution of trade law in the last two decades. The book also paves the way for the further research necessary to design a fully-fledged reform proposal of the EU framework for the transfer of personal data outside the European Economic Area.

This book traces the fascinating history of the first Polish gay and lesbian magazines to explore the globalization of LGBT identities and politics in Central and Eastern Europe during the twilight years of the Cold War. It details the emergence of homosexual movement and charts cross-border flows of cultural products, identity paradigms and activism models in communist Poland. The work demonstrates that Polish homosexual activists were not locked behind the Iron Curtain, but actively participated in the transnational construction of homosexuality. Their magazines were largely influenced by Western magazines: used similar words, discussed similar topics or simply translated Western texts and reproduced Western images. We apply a new approach to a new panel data set on bilateral gross cross-border equity flows between 14 countries, 1989-96. The model integrates elements of the finance literature on portfolio composition and the international macroeconomics and asset trade literature. Gross asset flows depend on market size in both source and destination country as well as trading costs, in which both information and the transaction technology play a role. Distance proxies some information costs, and other variables explicitly represent information transmission, an information asymmetry between domestic and foreign investors, and the efficiency of transactions. The remarkably good results have strong implications for theories of asset trade. We find that the geography of information is the main determinant of the pattern of international transactions, while there is little support in our data for diversification and return-chasing motives for transactions."--Authors.
