Conventional wisdom in the theory and practice of investment treaty arbitration says that the jurisdiction of arbitral tribunals is regulated by party consent. In Beyond Consent: Revisiting Jurisdiction in Investment Treaty Arbitration, Relja Radović investigates the formation of another layer of jurisdictional regulation, which is developed by arbitral tribunals. The principle that the jurisdiction of arbitral tribunals is governed by party consent stems from the foundations of the international legal order. Against that background, Radović surveys case law and analyses the development of arbitrator-made jurisdictional rules, which complement those defined by disputing parties. He then argues in favour of recognising the regulatory function of arbitral tribunals in the jurisdictional structure of investment treaty arbitration.

Radical alternatives to consent and trauma Contemporary discourse on sex and sexuality is fixated on consent as a means of mitigating danger and avoiding forms of sexual trauma. Sexuality Beyond Consent dares us to step into a different territory, where we do not guard the self but risk experience. Avgi Saketopoulou maintains that we are overly focused on healing trauma and need to reroute our attention to what subjects do with their trauma, in the process taking up a series of provocative questions: Why is sexuality beyond consent worth risking, and how does risk become a way of soliciting the future? Why might surrendering to the fact that your pain is not going away enable you to do things with pain? In what ways are race and racism shot through with the erotic? How can something proximal to violation become a site of flourishing? Nothing is "pure" in America, and, indeed, the rich ethnic mix that constitutes our society accounts for much of its amazing vitality. Werner Sollors's new book takes a wide-ranging look at the role of "ethnicity" in American literature and what that literature has said--and continues to say--about our diverse culture. Ethnic consciousness, he contends, is a constituent feature of modernism, not modernism's antithesis. Respect for autonomy has become a fundamental principle in human research ethics. Nonetheless, this principle and the associated process of obtaining informed consent do have limitations. This can lead to some groups, many of them vulnerable, being left understudied. This book considers these limitations and contributes through legal and philosophical analyses to the search for viable approaches to human research ethics. It explores the limitations of respect for autonomy and informed consent both in law and through the examination of cases where autonomy is lacking (infants), diminished (addicts), and compromised (low socio-economic status). It examines alternative and complementary concepts to overcome the limits of respect for autonomy, including beneficence, dignity, virtue, solidarity, non-exploitation, vulnerability and self-ownership. It takes seriously the importance of human relationality and community in qualifying, tempering and complementing autonomy to achieve the ultimate end of human research - the good of humankind.
