The Small Claims Procedure Act, K.S.A. 61-2701 et seq., does not prohibit a handicapped person who appears as a party in an action under that act from utilizing the assistance o some other individual in the presentation of the party's claim or defense in such an action, here such assistance is designed to permit the handicapped party to present his or her claim effectively despite speech, hearing or other impairments which would otherwise hinder or prevent such handicapped person from utilizing the small claims procedure act for the resolution of disputes.

A bank card draft which is authorized by 1977 Senate Bill 76 as a bond for offenses enumerated in K.S.A. 8-2107(d), as amended, is not an acceptable and sufficient bond unless said draft will be honored by the issuing institution by payment to the court of the full amount required for the offense involved by subsection (d). The bond represents an obligation to the State of Kansas, and no official of the state, including the court accepting said bond, is authorized to accept payment thereof at a discounted rate in an amount less than the full amount required by law for the offenses involved.

(1) Industrial revenue bond issues to qualify as exempt from Ch. 62, L. 1977 (Act), must comply with SEC Rule 146, and securities commissioner is without authority to promulgate regulations requiring municipalities to file notice of any reliance upon exemption from Act. (2) An IRB notice is timely filed if originally complete and on file at least 30 days prior to issuance of bonds. Securities commissioner has authority to find IRB notice timely filed if it has been on file requisite 30 days even if it was filed before effective date of Act. (3) The term "complete" as employed in the Act means that items of information and documents all as specifically delineated in Act are filed in commisisoner's office without regard to substance or content. (4) Commissioner has discretion to interpret provisions of the Act and may do so by issuing non-rule or nonregulation guidelines, but which are not binding and enforceable. (5) Commissioner is not authorized to require evidence of compliance with Section 5 as a condition of his finding IRB notice to be complete and timely filed.

It is within the constitutional power of the legislature to enact curative legislation, subsequent to the approval of a bond issue for county hospital purposes which is in excess of the statutory authority therefor, to enlarge such authority retroactively and validate bonds previously approved by the voters. The enactment of 1977 Senate Bill No. 459 will not deprive the plaintiffs in Thomas County Taxpayers Association v. Finney, Shawnee County District Court, no. 77-CV-0009, of the opportunity to pursue other issues which have been asserted in that litigation, or in any way deprive plaintiffs of their day in court.
