Transportation network companies (“TNCs”) such as Uber and Lyft manage ridesharing platforms that have increased efficiency and convenience for many passengers. These platforms, however, have also opened the door to many legal and regulatory issues pertaining to their business practices, employment structures, and transportation law and policy. This article provides a perspective on the economic, social, technical, and political aspects of TNCs in two steps, focusing on transportation and employment. First, it examines the future of TNCs in transportation, noting that TNCs could do more in terms of environmentalism to live up to the promise of the “sharing” economy. Second, the article analyzes the interaction of TNCs with labor and employment law. It proposes development of basic protections from the negative side of the TNCs management model, i.e. precarious labor and automatic management through algorithmic surveillance.

The rise of Transportation Network Companies (TNCs) such as Uber and Lyft have led to many questions about these companies’ effects on both the taxi industry and larger patterns of nonstandard work arrangements. This study uses multiple regression analysis to explore the association between the presence of TNCs and taxi driver employment, unincorporated self-employment, and multiple job-holding, based on information about when TNCs expanded into specific Metropolitan Statistical Areas and data from the Current Population Survey. This study did not find evidence that transportation network companies such as Uber and Lyft have yet had a significant impact on taxi employment in the metropolitan areas in which they operate, or that their presence is associated with an increase in multiple job holding. However, the analysis does suggest that the presence of TNCs may be associated with a modest increase in the likelihood that individuals in the labor force will identify as self-employed in their primary job.

Recently, a number of public transportation agencies have formed partnerships with Transportation Network Companies (TNCs) such as Uber and Lyft. Proponents of these collaborations emphasize their potential to expand the reach of public transportation systems, while skeptics caution that transit agencies should not divert resources from core bus and rail networks, and should not rely upon drivers who lack basic health and employment benefits. This thesis contributes to the growing body of research around TNC partnerships by focusing on one important dimension: the degree to which these partnerships meet the standards of federal civil rights law. Laws such as Title VI of the Civil Rights Act of 1964 require transit agencies to ensure that the benefits and burdens of their services are distributed equally. And yet despite the importance of these laws, little is known about how transit agencies are meeting their civil rights obligations in the context of partnerships with TNCs. To shed light on this question, I reviewed the existing research on TNC partnerships and conducted eighteen interviews with officials from transit agencies, advocacy organizations, and the Federal Transit Administration. I have found that the level of attention and regulatory innovation has varied across civil rights regimes. Many transit agencies have devoted substantial attention to the Americans with Disabilities Act, finding new ways to use these partnerships to improve mobility for people with disabilities. And yet, four years into this series of partnerships, there has been much less innovation with regard to Title VI and the Executive Order on Environmental Justice, which together prohibit discrimination on the basis of race and income. With a few limited exceptions, transit agencies have generally not taken the steps needed to ensure that TNC partnerships comply with these bedrock civil rights provisions. This is an area where advocates, regulators, and transit agencies should devote greater attention. If these partnerships are to play a role in the future of public transportation--as some advocates believe they should—they must satisfy the basic legal and ethical imperative of providing service transparently and equitably.

This book charts the path to revitalisation for trade unions in Australia, the USA, the UK, and Italy. It examines the examples of innovation and digital campaigning that are enabling unions to build new forms of worker power – and overcome decades of declining membership wrought by neoliberalism, globalisation, and hostility from employers and the state. The study evaluates the responses of unions in each country to falling membership levels since the 1980s. It considers the US 'organising model' and its adoption in Australia and the UK, comparing this with the strategies of Italian unions which have been more deliberately focused on precarious and migrant workers. The increasing reliance of US unions on community alliances, as seen in the 'Fight for $15' and similar campaigns, is scrutinised along with new union prototypes like Hospo Voice in Australia, the Independent Workers' Union of Great Britain and SI Cobas in Italy. The book includes an in-depth analysis of union responses to the gig economy in the four countries, and the emergence of self-organised worker collectives to combat this exploitative business model. The vital role played by unions in defending the interests of workers during the COVID-19 pandemic is also examined.
