El objetivo de estas lecciones es facilitar a los alumnos de primer curso del grado en derecho una aproximación a la realidad jurídica desde la Teoría del Derecho. Esta disciplina no estudia, pues, ningún sistema jurídico en particular, ni constituye una introducción a los principales contenidos de ninguno de ellos. Ofrece, por el contrario, un conjunto de conceptos, distinciones, clasificaciones y argumentos con los que intentar responder a un tipo cuestiones bastante diferente: qué es el derecho, cómo puede ser definido, por qué es necesario, qué problemas derivados de la condición humana y de la vida humana en sociedad viene a solucionar y, en tal medida, por qué debemos obedecerlo o desobedecerlo. Para dar respuesta a este tipo de interrogantes e inquietudes que despierta la existencia del Derecho es preciso, sin duda, del auxilio de ciencias sociales como la psicología, la antropología, la historia, la sociología, etc. Sin embargo, en último término, son problemas siempre abiertos que precisan también y, sobre todo, de la Filosofía. A estas cuestiones dedicaremos las dos primeras lecciones de este texto. Las cuatro siguientes están dedicadas a examinar la estructura formal no de todos los sistemas jurídicos posibles sino, fundamentalmente, de aquellos surgidos en Europa a partir de la modernidad (finales del siglo XV) y, sobre todo, de la codificación (finales del XVIII), tomando particularmente en consideración las trasformaciones en el derecho provocadas por la constitucionalizarían del sistema político y jurídico acaecida después de la segunda guerra mundial. Con tal propósito se estudian, en primer lugar, las unidades más elementales de un ordenamiento jurídico, como son sus normas. Trataremos de explicar lo que son a partir de su consideración como entidades características de un cierto tipo de lenguaje, y examinaremos la distinta estructura y funciones de las prescripciones jurídicas. También se analizarán en profundidad los tres tipos de juicios que pueden hacerse de las normas jurídicas: si son válidas, si son eficaces y si son justas. Asimismo, profundizaremos en la comprensión de lo que significa que las normas jurídicas conforman, al menos idealmente, un conjunto de enunciados entre los que existen relaciones lógicas características de un sistema formal. Finalmente, abordaremos cómo nacen las normas jurídicas examinando el concepto de fuentes del derecho o modos de producción jurídica.
