It concentrates on grounds that have arisen post-registration, but the somewhat ambiguous wording of s 88(2)(c) also prompts consideration of trade marks that are likely to deceive or cause confusion at both the registration and rectification stages. The grounds for rectification under s 88(2)(a) contain all of the grounds upon which the original registration of a trade mark could have been opposed or rejected. The article questions whether s 88(2)(a) is capable of a continuing operation such that those grounds would be available where the invalidity in the trade mark arose after registration, and argues that it is not. It then critically evaluates the somewhat ambiguous wording of s 88(2)(c) and the rather confusing and embryonic case law dealing with the provision, and an interpretation of s 88(2)(c) is proposed. The limited scope for rectification of trade marks registered under the Trade Marks Act 1955 (Cth) is considered.
