La aparición de una "economía del conocimiento global" —muy dependiente de la innovación— ha situado la regulación de la propiedad intelectual en el centro de los debates académicos y sobre políticas públicas. Desde la perspectiva de las relaciones internacionales y del comercio, la importancia del tema es manifiesta cuando se observa la reciente avalancha de negociaciones multilaterales y bilaterales en las que invariablemente se discuten los límites hasta dónde debe llegar la protección de la propiedad intelectual (Stiglitz 2007). Desde el punto de vista jurídico, la gobernanza del conocimiento constituye uno de los pocos campos en los que el sistema multinacional se ha establecido con firmeza. Los convenios de la Organización Mundial de la Propiedad Intelectual (ompi) —estos son el Convenio de París, que cubre patentes y marcas, y el Convenio de Berna, sobre derechos de autor— han existido desde finales del siglo xix1 . Y en 1995, la Organización Mundial de Comercio (omc) añadió el Acuerdo sobre Aspectos de la Propiedad Intelectual relacionados con el Comercio (adpic) a su lista de instrumentos obligatorios.

Desde la perspectiva de la relaciones internacionales y el comercio, la importancia del tema es patente cuando se observa la reciente avalancha de negociaciones bilaterales y multilaterales, que suscitan la cuestión de hasta dónde debe llegar la protección de la propiedad intelectual. Desde el punto de vista jurídico, la gobernanza del conocimiento constituye uno de los pocos campos en los que el sistema multinacional se ha establecido con firmeza. La propiedad intelectual es -como el control del cambio climático, la política monetaria y la seguridad nacional- un área en la actividad de un país tiene importantes efectos derivados no buscados en otros. Por consiguiente, como ocurre en otras áreas, la propiedad intelectual se ha convertido también en objeto de un marco regulatorio transnacional muy complejo. Este libro analiza la forma como se produce la variación en las normas jurídicas y las prácticas, es decir, cómo las interacciones complejas entre participantes en este campo regulatorio -gobiernos nacionales, instituciones internacionales, reguladores públicos y privados, tribunales, empresas transnacionales, productores nacionales, abogados societarios y activistas de las ONG- configuran el derecho local e internacional y como estos a su vez son configurados por ese derecho. En particular, se estudian los debates relativos a aquellos aspectos del derecho local e internacional, y cómo estos a su vez son configurados por ese derecho de la propiedad intelectual que inciden en el acceso a los medicamentos; es decir, las medidas que regulan la adquisición, el reconocimiento y el uso de derechos de patentes sobre los productos farmacéuticos y los secretos comerciales sobre los datos relativos a ellas, junto con las condiciones en las cuales estos derechos ceden ante el interés en el acceso al público a medicamentos genéricos más baratos.
