The Roles of International Law in Development provides an in-depth analysis of the relationship between public international law and development. Unlike the existing body of literature on public international law, this book investigates how international law and development interact, and evaluates how significant a role international law plays in development. Water cooperation has received prominent focus in the post-2015 United Nations Sustainable Development Goals (SDGs). While proposals for measuring water cooperation appear to be converging toward a small set of indicators, the degree to which these proposed indicators draw on past work is unclear. This paper mines relevant past work to generate guidance for monitoring the proposed SDG target related to transboundary water cooperation. Potential measures of water cooperation were identified, filtered and applied in three countries (Botswana, South Africa and Zimbabwe). Six indicators were ultimately determined as being suitable for measuring water cooperation. As the SDG process turns its focus to the selection of indicators, the indicators proposed in this paper may merit consideration

It is now widely accepted that the world is likely to face a major water crisis unless the present management practices are improved very significantly. Promoted extensively by donors and international institutions over the past 15 years, integrated water resources management (IWRM) has been assumed explicitly to be "the" solution for managing the limited water resources of the world. Hundreds of millions of dollars have now been spent in promoting IWRM in developing countries. However, no serious and objective analysis has ever been undertaken as to whether IWRM has made water management more efficient and equitable in any region of the world than otherwise may have been the case. This pioneering analysis indicates that IWRM has not only been unsuccessful in Latin America, but also is highly unlikely to succeed in the future. At the UN General Assembly in 1997, an overwhelming majority of States voted for the adoption of the United Nations Convention on the Law of the Non-Navigational Uses of International Watercourses – a global overarching framework governing the rights and duties of States sharing freshwater systems. Globally, there are 263 internationally shared watersheds, which drain the territories of 145 countries and represent more than forty percent of the Earth's land surface. Hence, inter-State cooperation towards the sustainable management of transboundary water supplies, in accordance with applicable international legal instruments, is a topic of crucial importance, especially in the context of the current global water crisis. This volume provides an assessment of the role and relevance of the UN Watercourses Convention and describes and evaluates its entry into force as a key component of transboundary water governance. To date, the Convention still requires further contracting States before it can enter into force. The authors describe the drafting and negotiation of the Convention and its relationship to other multilateral environmental agreements. A series of case studies assess the role of the Convention at various levels: regional (European Union, East Africa, West Africa, Central Asia, Central America and South America), river basin (e.g. the Mekong and Congo) and national (e.g. Ethiopia and Mexico). The book concludes by proposing how future implementation might further strengthen international cooperation in the management of water resources, to promote biodiversity conservation as well as sustainable and equitable use.
