Book Description
Excerpt from A Treatise on the Law of Sale of Personal Property, Vol. 1 of 2 The present work was projected in 1887 and something was then done upon it. It was, however, temporarily laid aside for other tasks, until January, 1892. Since that time it has been constantly in hand and has been prosecuted as rapidly as health and the pressure of many other duties would permit. Not withstanding the utmost effort, however, it has been delayed long beyond the time originally fixed for its completion. As it is, the book is very far from being what the writer hoped to make it, or what he still believes he might have made it, had his work been done under more favorable conditions. To retain it longer, however, for further elaboration seems neither practicable nor wise. The general outline and arrangement of Mr. Benjamin have, in the main, been adopted. This course was decided upon for two reasons: first, because Mr. Benjamin's classification has always been regarded as excellent in itself; but secondly and chiefly, because Mr. Benjamin's analysis (which in its turn was largely that of Lord Blackburn) has so decidedly controlled the development of our law in many important particulars, that to attempt a new classification or nomenclature would be confusing if not presumptuous. Mr. Benjamin's text, more over, has been freely drawn upon for statements of the Eng lish law. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book Description
Excerpt from Benjamin's Treatise on the Law of Sale of Personal Property With References to the American Decisions, Vol. 1 of 2 It is believed that the foregoing summary includes mos: of the topics under the law of sale, on which the American and the English courts disagree and it will be observed that there is high American authority to be found in accord with the English decisions on many of these points. On the whole, considering the wide range of the Subject, the differences are remarkably few. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book Description
Excerpt from A Treatise on the Law of Sale of Personal Property: With References to the American Decisions and to the French Code and Civil Law The favourable reception given to the work in the United States has encouraged the insertion of a larger number of American decisions; but in order to avoid an unnecessary increase in the bulk of the volume, refer ence has generally been confined to the latest leading case in the Reports of the Supreme Court of the United States, and of the Court of Appeals in the State of New York. This will suffice to guide the reader to the authorities in the Courts of the other States. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book Description
Excerpt from A Treatise on the Law of Personal Property The object of the present edition has been two-fold, namely. To eliminate entirely from the original work so much of its text as is inapplicable in the United States, and to supply, instead, a fur ther presentation, upon the latest authorities, English and American, of the law of the subjects treated of in the retained text, together With that of sundry topics of importance not therein discussed. The few notes which have been retained are, as indicated by the initials G. W, the work of the learned editors of the last edition of Williams on Personal Property, Messrs. Gerhard and Wetherill, of the Philadelphia bar. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books.
