The second volume con tained the Law of Marine Insurance, and the Law of Admiralty. In preparing a new edition of this work, I found that the recent cases on the subject of Marine Insurance, and especially those on General Average in connection with Insurance, in England and in this co un try, from their number, their interest, and their effect upon those important branches of Commercial Law, made it impossible to confine the work within its former limits. I determined, therefore, after much consultation with persons in different parts of our country whose Opinions on such a question would be most valuable, to prepare a new work on the Law of Marine Insurance, founding it upon my former work, but so increasing its size as to enable me to make it as complete as I could. Excerpt from A Treatise on Maritime Law, Vol. 1 of 2: Including the Law of Shipping, the Law of Marine Insurance, and the Law and Practice of Admiralty Before I came to Cambridge, and while still engaged in the business of my profession, I had become convinced that the books in the different departments of maritime law, excellent as some of them were, were still Open to the objection, that they treated severally and disconnect edly, topics which in themselves were closely connected and needed the mutual illustration they could give each other. It seemed to me that the Law of Shipping and the Law of Marine Insurance, for example, could not be learned fully and accurately excepting in their connec tion. How these subjects intermingle in some of their subdivisions, is obvious. Thus, no work on Shipping would leave the subject of General Average untouched; and certainly no work on Insurance could do so. But does this topic belong more properly to Shipping or to Insurance? It belongs to both; and equally to both; and connects the two together. And to go beyond this, it may be said that there is no topic of either of these systems of law, which can be treated of with any ful ness, without a frequent reference, more or less direct, to the same topic as it stands in the other of those sys tems. Excerpt from Arnould on the Law of Marine Insurance, Vol. 1 of 2 A new Edition of this Treatise, revised throughout with assiduous reference to the authorities up to the latest decisions, including the Reports issued in December last, is here submitted to the Profession and to the Mercantile Community. The Court of Appeal in Stewart v. Merchants' Mar. Ins. Co. animadverted with just severity on the retention of the 3 per cent, memorandum as affecting ship in the terms in which it was introduced into the policy about 1749, unmodified in any respect, notwithstanding the vast increase in size and costliness of our ocean steamers. In one of the notes to that case a suggestion is offered with a view to stimulating discussion, in order that such a reform of that memorandum may be arrived at, as may maintain a somewhat more reasonable proportion to the present development of British Shipping. So simple a matter as the stamps and stamp laws in relation to policies is disgracefully perplexed on the face of the Statutes by piece-meal alterations on previous alterations. In the Appendix of Statutes the eye will find assistance from slight notes interspersed between the sections. At the same time the subject has been dealt with in the text in a simple and intelligible way, such as, it is hoped, will be generally acceptable.
