Trata-se sobre a "efetividade da função social da propriedade para implementar o uso compulsório do vazio urbano em Cáceres", onde os vazios são áreas desabitadas, descampadas e situadas em locais de adensamento demográfico, caracterizadas pela existência de edificações igualmente desabitadas e localizadas em áreas equipadas com serviços públicos coletivos e individuais. O objetivo foi analisar a efetividade do princípio da função social da propriedade nas ações do Poder Público cacerense, no aproveitamento adequado compulsório do solo urbano vazio. Isto, a partir de seu Plano Diretor, o instrumento básico de política e desenvolvimento e expansão urbana. Tem como fundamento o plano pragmático de concretização da norma jurídica, que deve ter, além da conexão "norma sistema" e "norma valores sociais", o necessário empenho de governantes, elites e da população em respeitar o ordenamento jurídico e fazer valer os princípios retores da ordem normativa. A CF Brasileira faculta ao Poder Público municipal, mediante a lei, o poder de exigir do proprietário do solo urbano não edificado, subutilizado ou não utilizado, que promova seu adequado aproveitamento, sob pena, sucessivamente, de parcelamento, IPTU progressivo no tempo e desapropriação. A natureza deste trabalho é de uma pesquisa qualitativa e descritiva por determinar quando, quanto, onde e como o fenômeno da função social da propriedade, ocorre dentro das hipóteses constitucionais, e diretrizes gerais fixadas, no Estatuto da Cidade. Quanto à profundidade, analisa-se a efetividade do princípio constitucional prevista em norma municipal, tanto jurídica quanto social, visando ao atendimento das exigências fundamentais de ordenação da cidade.
