On the Ethics of Torture
Author: Uwe Steinhoff
Publisher: SUNY Press
ISBN: 1438446217
Category : Philosophy
Languages : en
Pages : 206
Book Description
The question of when, and under what circumstances, the practice of torture might be justified has received a great deal of attention in the last decade in both academia and in the popular media. Many of these discussions are, however, one-sided with other perspectives either ignored or quickly dismissed with minimal argument. In On the Ethics of Torture, Uwe Steinhoff provides a complete account of the philosophical debate surrounding this highly contentious subject. Steinhoff s position is that torture is sometimes, under certain narrowly circumscribed conditions, justified, basing his argument on the right to self-defense. His position differs from that of other authors who, using other philosophical justifications, would permit torture under a wider set of conditions. After having given the reader a thorough account of the main arguments for permitting torture under certain circumstances, Steinhoff explains and addresses the many objections that have been raised to employing torture under any circumstances. This is an indispensible work for anyone interested in one of the most controversial subjects of our times.

International Criminal Law and Philosophy
Author: Larry May
Publisher: Cambridge University Press
ISBN: 0521191513
Category : Law
Languages : en
Pages : 269
Book Description
The purpose of this book series is to clarify and improve the theoretical foundations of international law. Too often the progressive development and implementation of international law has foundered on confusion about first principles. This series will raise the level of public and scholarly discussion about the structure and purposes of the world legal order and how best to achieve global justice through law. The idea for this series grows out of the International Legal Theory project of the American Society of International Law. Each year for the past decade, the ASIL has devoted special attention to a different aspect of international law and has invited scholars and practitioners to discuss the theoretical basis of such topics as customary international law, humanitarian law, and human rights. The ASIL Studies in International Legal Theory series will deepen this exchange by publishing scholarly monographs and edited volumes of essays considering subjects in international legal theory. Book jacket.

Tyranny Through Public Education - Revised Edition
Author: William F. Jr Cox
Publisher: Xulon Press
ISBN: 1594675430
Category : Education
Languages : en
Pages : 558
Book Description
This book documents the inherently flawed nature of America's public school system as currently structured. Contemporary recommendations for correcting the system invariably treat symptoms rather than the inherent problem of government control over parental and religious rights. The book documents that: education is a religious endeavor and that freedom of religion is guaranteed in the United States, parents have an inalienable right to raise their children free from government constraints on education, civil government is to protect and not deprive citizens of their inalienable rights, the educational history of our country affirms that education has always had a religious function, recent interpretations of the First and Fourteenth Amendments are both misguided and opposite from their original meanings, federal control of education and education taxation is outside the legitimate authority of the U.S. Constitution, and government control of education at federal, state, and local levels is inherently tyrannical. Addressed in separate chapters, the above-mentioned issues, individually and collectively, build a compelling case for the disestablishment of government control and the return of parental control to education. To quote James Madison, government should relate to education in the same way as it does to religion-not to "intermeddle" with it.
