Consumer out-of-court redress in the European Union is experiencing a significant transformation; indeed the current changes are the most important that have occurred in the history of the EU. The New Regulatory Framework for Consumer Dispute Resolution examines the impact of the new EU law in the field of consumer redress. Part I of the volume examines the new European legal framework and the main methods of consumer redress, including mediation, arbitration, and ombudsman schemes. El fomento de los métodos alternativos de resolución de conflictos viene siendo un objetivo del Derecho de la Unión Europea, que se ha ido potenciando progresivamente en las últimas dos décadas, especialmente en sede de protección de los derechos de los consumidores y usuarios. En Derecho privado español se han intentado secundar estos objetivos desde un planteamiento que ha evolucionado significativamente. En el planteamiento inicial, al que responden tanto la Ley 60/2003, de 23 de diciembre, de arbitraje, como la Ley 5/2012, de 6 de julio, de mediación en asuntos civiles y mercantiles, se fomenta el uso de los medios extrajudiciales de solución de conflictos en Derecho privado desde los principios de libertad y de libre autonomía de la voluntad y, en consecuencia, desde el carácter voluntario de la utilización de medios de solución de conflictos alternativos a la jurisdicción. Sin embargo, ante la escasa implantación que tuvo la mediación en la práctica jurídica tras estas iniciativas legislativas, las últimas propuestas realizadas por el pre-legislador español de fomento de los métodos alternativos de resolución de conflictos mudan su carácter o naturaleza para configurarlos con carácter obligatorio, como sucede en el actual Proyecto de Ley de medidas de eficiencia procesal del servicio público de justicia de 2022. Por esta vía, desde una perspectiva de legalidad ordinaria, se introduce en el proceso civil un requisito de procedibilidad previo a la presentación de la demanda y, desde una perspectiva constitucional, se incorpora una restricción en el acceso a la jurisdicción, que afecta al derecho fundamental a la tutela judicial efectiva reconocido en el art. 24. 1 CE y en el art. 47 CDFUE y que puede resultar compatible con él, siempre que se respeten ciertos límites, que ha ido desgranando la reciente jurisprudencia del TC y del TJUE y que se analizan en esta obra.
