Ever since the Elephantine papyri were first published over a century ago, scholars have speculated on the origins of the well-developed legal formularies used in these documents. Since then, many more Aramaic deeds of conveyance both from Elephantine and from elsewhere have been published, especially within the last decade or so. With this expanded text base now available, the time is ripe for a comprehensive re-assessment of these legal formularies. This book endeavors to show that these disparate Aramaic documents, whose chronological scope spans several centuries, form a discrete and coherent tradition. It isolates and identifies the distinctive elements that form the core of this tradition and traces the histories of these elements back through the cuneiform record.

In their study of social practices deemed traditional, scholars tend to use the concept and idea of tradition as an element of meaning in the practices under investigation. But just whose meaning is it? Is it a meaning generated by those who study tradition or those whose traditions are being studied? In both cases, particular criteria for traditionality are employed, whether these are explicated or not. Individuals and groups will no doubt continue to uphold their traditional practices or refer to their practices as traditional. While they are in no way obliged to explicate in analytical terms their criteria for traditionality, the same cannot be said for those who make the study of traditions their profession. In scholarly analysis, traditions need to be explained instead of used as explanations for apparent repetitions and replications or symbolic linking in social practice, values, history, and heritage politics. This book takes a closer look at ‘tradition’ and ‘folklore’ in order to conceptualize them within discourses on modernity and modernism. The first section discusses ‘modern’ and ‘traditional’ as modern concepts and the study of folklore as a modern trajectory. The underlying tenet here is that non-modernity cannot be represented without modern mediation, which therefore makes the representations of non-modernity epistemologically modern. The second section focuses on the nation-state of Finland and the nationalistic use of folk traditions in the discursive production of Finnish modernity and its Others. The insights are applicable worldwide in discussions on cultural representation.

Several ofthe themes of this study have been treated in earlier publica tions, some by means of a general analysis and some through a detailed handling of problems raised by a particular theme or historian. Both the more general theoretical treatment of the theme and the concrete historiographical treatment are, I think, indispensable aids to the proper understanding of the development of historical scholarship in nineteenth-and twentieth-century England. There are a number of problems in a concrete historiographical approach: there is first the mass of historians to be faced, and then the immense amount of historical themes dealt with in various periods. As a guideline through the tangle of themes we chose the historiography on the development of the English parliament. We can only hope that we have made a responsible choice of the historians concerned. Un fortunately it was not always possible for us to give extensive biogra phies of some of the more recent historians, as several 'papers' are still firmly in the possession of families, and a number of them mus- despite of years - still be labelled 'confidential.' The Pollard Papers in the London Institute of Historical Research thus remained inaccessible. Fortunately the lack was partly compen sated by some important material being found apart from these Papers.

Fragmentary texts play a central role in Classics. Their study poses a stimulating challenge to scholars and readers, while its methods and principles, far from being rigidly immutable, invite constant reflection on its methods, approaches, and goals. Historians have long viewed Louisiana as an anomaly in the American judicial system-an eccentric appendage at the mouth of the Mississippi River. The diverse Creole culture and civilian heritage of the state's legal system have led many scholars to conclude that it is an anachronism in American law unworthy of serious attention. Others embrace this tradition and revel in the minutiae of the Pelican State's unique civil law legacy. In From Chaos to Continuity, Mark F. Fernandez challenges both perspectives. Using the innovative methods of the New Louisiana Legal History, he offers the first comprehensive analysis of the role of the courts in the development of Louisiana's legal system and convincingly argues that the state is actually a representative model of American law and justice. Tracing the rise of Louisiana's system from its earliest colonial origins to its closure during Federal occupation in 1862, Fernandez describes the introduction of common law after American takeover of the colony; the chaotic combination of French, Spanish, and Anglo legal traditions; the evolution of that jurisdiction; the role of the courts-especially the state supreme court-in maintaining the mixture; and the judge's proper function in administering justice. According to Fernandez, the challenge of integrating two very different systems of law was not unique to Louisiana. Indeed, most antebellum southern states had legal systems that incorporated important traditional aspects of their colonial legal orders to varying degrees.
