Law is often perceived as an instrument that can effect social change. While this might be so, it must be complemented by the necessary financial and human resources to make the law effective. Natalie Persadie explains that, among developing countries, such as Trinidad and Tobago, the achievement of legal advances for women--at either the international or national levels--is particularly difficult where practical measures are not subsequently implemented. This is, perhaps, attributable to a lack of political will. Important issues such as gender equality and domestic violence are not given priority and laws aimed at protecting women and promoting women's rights are ineffective, scant, or unenforced. Gender justice can only be realized through a multilevel approach from above and, more importantly, from below, as women have the potential to effect real national and international legal and institutional change to ensure gender equality at both levels.

2020 marks the 25th anniversary of the adoption of the Beijing Platform for Action. It also marks the first time that progress on the implementation of the Platform is reviewed in light of the 2030 Agenda for Sustainable Development, adopted in 2015. This report therefore takes an integrated approach to reporting on progress, gaps and challenges related to the advancement of gender equality and women's rights across six dimensions that link the Platform's critical areas of concern and the Sustainable Development Goals. This book analyses the impact that stabilization clauses have on the development of human rights and gender laws in resource rich nations. Given the fact that stabilization clauses freeze the law for as long as the contract subsists there has been debate on the negative impact stabilization clauses have on the progressive development of human rights in the host State. Firstly, the book examines the mechanisms investors utilise in protecting themselves from host State prerogatives. It then explores the theoretical basis on which stabilization clauses are applied and upheld by arbitral tribunals, and assesses how they can be drafted in a way that protects human rights, particularly in relation to gender discrimination, without forcing the resource rich nations to lose momentum in attracting foreign direct investment. Using Zambia and the Gender Equity and Equality Act of 2015 as a case study, the book explores the compatibility of the legislation with the stabilization clauses contained in the country’s Development Agreements. The book will be of interest to practitioners, scholars and students of international investment law, human rights law and contract law.
