Excerpt from The Western Law Times of Canada, Vol. 6 Lord Hobhouse delivered judgment. He stated that the statute 9 Geo. II., c. 35, the statute of Mortmain, it was expressly enacted, should not extend to Scotland. After a time came the question whether it extended to the colonies, and that question was settled in the negative in the case of attorney-general v. Stewart, 2 Mer. 143, deci ded by Sir Wm. Grant in the year 1817. He considered that both the mischief struck at by the Act, and the meth ods prescribed for lawful gifts, were of a local character peculiar to England. Therefore he held that the Act did not extend to Grenada, though it is in general terms, and though the laws of England had been extended in general terms to the island when first ceded in 1763 and again when recovered in 1784. That Opinion has ever since pre vailed, and in the case of the Gilchrist foundation Whicker v. Ham, 7 H. L., it was applied to a gift of land in New South Wales. It seems, however, that it might be argued from Whit by v. Liscombe, 23 Grant 1, that it might be held that the statutes were at one time in force in Ontario, but any question' of this kind is apparently decided by this recent case. Excerpt from The Canadian Law Times, 1896, Vol. 16 It is evident that the value of the Reports depends upon their authenticity The more famous cases were reported only by permission under the authority of the Court. These official reports must therefore be critically examined before they are accepted. This work was thoroughly done by the earlier editors, and any reader can acquaint himself with the relative authenticity of the reports. It is somewhat of a surprise to any person who takes up these volumes to see that they contain verbatim re ports. In this matter, as in so many others, there is nothing new under the sun. Shorthand reporting is a very ancient art, although we are apt to think it dates only from Pitman. It was well known to the Romans, as every student of Roman history is aware. During the middle ages the art was lost. In England, the revival dates from John Willis, whose Stenographie pawed through thirteen editions between 1602 and 1644. His system was alphabetic, that is, each word had its own symbol. Between him and Pitman there were two hundred systems invented. Of these, only seven were phonetic. All the others were, like Willis', alphabetic But, such as they were, they were used extensively, and thus we are able to read the ipsissima verba used by all the noted persons whom trial inter ests us subsequent to the death of Queen Elizabeth.
