This book provides a comparative analysis of how judgments from the European Court of Human Rights (ECtHR) and the Inter-American Court of Human Rights (IACtHR) affect political participation and electoral justice at the national level. Looking at specific countries, the work analyses the legal impact the implementation of the ECtHR and the IACtHR judgments has, with a specific focus on cases in which the regional court concerned uses the “democratic argument,” that is, an argument related to democracy and political rights. The reasoning is that, although democracy is a much wider concept, judgments concerning violations of political rights and electoral justice provide reliable indicators to assess the status and sustainability of democracy in a State. Moreover, the analysis of the violations of political rights and electoral justice allows an in-depth comparison between the two regional human rights systems. Mindful of the broader scope of the fall-out generated by the non-implementation of judgments, including in socio-economic terms, the book includes a section exploring how judgments issued by the ECtHR and the IACtHR affect voters’ participation in the countries under their jurisdiction. To this end, an original dataset including the 47 Member States of the Council of Europe and the 20 countries which recognised the adjudicatory jurisdiction of the IACtHR is built. Multidisciplinary in aim and scope of analysis, the book will be an invaluable resource for researchers, academics, and policy-makers working in the areas of constitutional law, international human rights law, and political economy.

This Commentary provides the reader with a review of international standards and practice relating to the political participation of minorities. Political participation has been increasingly recognized as a foundational issue in the debate about minority rights. It is argued that minorities are more likely to feel co-ownership in the state if they have the opportunity to participate freely and effectively in all aspects of its governance, and that sustained and meaningful engagement will guard against the sense of alienation and exclusion among minorities that often emerges in ethnically divided societies. Taking as its starting point the two most important standard-setting documents in the field - the Lund Recommendations on the Effective Participation of National Minorities in Public Life, developed by the Organization for Security and Cooperation in Europe, and the Council of Europe's Thematic Commentary on the Issue of Political Participation of Minorities - the Commentary locates the international legal entitlement to political participation within the wider context of the right to democratic governance. Asian Americans are a small percentage of the U.S. population, but their numbers are steadily rising—from less than a million in 1960 to more than 15 million today. They are also a remarkably diverse population—representing several ethnicities, religions, and languages—and they enjoy higher levels of education and income than any other U.S. racial group. Historically, socioeconomic status has been a reliable predictor of political behavior. So why has this fast-growing American population, which is doing so well economically, been so little engaged in the U.S. political system? Asian American Political Participation is the most comprehensive study to date of Asian American political behavior, including such key measures as voting, political donations, community organizing, and political protests. The book examines why some groups participate while others do not, why certain civic activities are deemed preferable to others, and why Asian socioeconomic advantage has so far not led to increased political clout. Asian American Political Participation is based on data from the authors’ groundbreaking 2008 National Asian American Survey of more than 5,000 Chinese, Indian, Vietnamese, Korean, Filipino, and Japanese Americans. The book shows that the motivations for and impediments to political participation are as diverse as the Asian American population. For example, native-born Asians have higher rates of political participation than their immigrant counterparts, particularly recent adult arrivals who were socialized outside of the United States. Protest activity is the exception, which tends to be higher among immigrants who maintain connections abroad and who engaged in such activity in their country of origin. Surprisingly, factors such as living in a new immigrant destination or in a city with an Asian American elected official do not seem to motivate political behavior—neither does ethnic group solidarity. Instead, hate crimes and racial victimization are the factors that most motivate Asian Americans to participate politically. Involvement in non-political activities such as civic and religious groups also bolsters political participation. Even among Asian groups, socioeconomic advantage does not necessarily translate into high levels of political participation. Chinese Americans, for example, have significantly higher levels of educational attainment than Japanese Americans, but Japanese Americans are far more likely to vote and make political contributions. And Vietnamese Americans, with the lowest levels of education and income, vote and engage in protest politics more than any other group. Lawmakers tend to favor the interests of groups who actively engage the political system, and groups who do not participate at high levels are likely to suffer political consequences in the future. Asian American Political Participation demonstrates that understanding Asian political behavior today can have significant repercussions for Asian American political influence tomorrow.

Although democratic governments have introduced a number of institutional reforms in part intended to increase citizens’ political involvement, studies show a continued decline in regular political engagement. This book examines different forms of political participation in democracies, and in what way the delegation of public responsibilities—or, the diffusion of politics—has affected patterns of participation since the 1980s. The book addresses this paradox by directly investigating the impact of institutional changes on citizens’ political participation empirically. It re-analyses patterns of political participation in contemporary democracies, providing an in-depth time series cross-sectional analysis that helps develop a better understanding of how variation in political participation can be explained, both between countries and over time. The United States imprisons far more people, total and per capita, and at a higher rate than any other country in the world. Among the more than 1.5 million Americans currently incarcerated, minorities and the poor are disproportionately represented. What’s more, they tend to come from just a few of the most disadvantaged neighborhoods in the country. For Trading Democracy for Justice, Traci Burch has drawn on data from neighborhoods with imprisonment rates up to fourteen times the national average to chart demographic features that include information about imprisonment, probation, and parole, as well as voter turnout and volunteerism. She presents powerful evidence that living in a high-imprisonment neighborhood significantly decreases political participation. Similarly, people living in these neighborhoods are less likely to engage with their communities through volunteer work. What results is the demobilization of entire neighborhoods and the creation of vast inequalities—even among those not directly affected by the criminal justice system.
