In March 2014, the OECD issued a report in which it indicated that the Netherlands “has an excellent track record on water management in several areas” The OECD mentions for example that the Netherlands has developed a “strong economy and robust water industry”, this despite that 55% of the Netherlands' territory is below sea level. However, the OECD also concluded that Dutch water governance “relies on a system of many checks and balances... [and] that system presents some limitations.” In response to the conclusion of the OECD, this paper discusses the current framework of economic regulation of the Dutch drinking water sector. The paper develops a normative framework to assess whether the current organization of economic regulation is adequate. The assessment examines to which extent the principles of good regulation are observed by economic regulation of the drinking water sector.It is concluded that the Dutch framework of economic regulation of the drinking water sector displays several weaknesses in light of the principles of good regulation. In particular, the principles of transparency and independency need better observance. As a result the protection of the interests of the users of drinking water are at stake. In order to improve the current organisation of economic regulation in the drinking water sector, this paper ends with some recommendations to enhance the quality of economic regulation of the Dutch drinking water sector.

Institutional Governance and Regulation of Water Services aims to provide the key elements of policy, governance and regulation necessary for sustainable water and sanitation services. On policy matters, it covers important aspects including separation of policy and delivery, integrated planning, sustainable cost recovery, provisions for the poor, and transparency. Regulation and Regulatory Bodies are presented in their various forms, with discussion of why some form of independent scrutiny is essential for sustainability. About the Author: Michael Rouse is a Distinguished Research Associate at the University of Oxford and manages the Institutional Governance and Regulation module of the University’s MSc Course on Water Science, Policy and Management. He was formerly Head of the Drinking Water Inspectorate in London and has extensive knowledge and experience of water governance and regulation, including all aspects of audit and enforcement, and the governance issues related to both public sector management and privatisation. He has wide knowledge of water technical and operational matters, based on his applied research and development background at the Water Research Centre, where he spent 9 years as Managing Director. Michael has a good understanding of international water matters and advises governments on policy and regulation. He is a Past President of the International Water Association. He is a visiting professor at Tsinghua University in Beijing and at the Shanghai Academy of Social Science. In 2000 he was awarded the CBE (Commander of the British Empire) for his professional services.

The establishment of dedicated regulatory bodies in charge of regulating water services, whilst being recent, is nevertheless a consistent trend among OECD and non-OECD countries. This report presents a picture as of September 2014 of the governance arrangements, operational modalities and use of regulatory tools across a sample of 34 established water regulators. It relies on the OECD Best Practice Principles for Regulatory Policy: The Governance of Regulators to structure the information collected through a survey exercise. It has been developed in close co-operation with the OECD Network of Economic Regulators (NER). The results from the survey show that the 34 water regulators show generally a high level of adoption of good governance principles and practices. They display functions and powers that are in line with their objectives. Water regulators also show a strong culture of consultation. Other areas, in particular evaluation of regulatory impacts, could be further strengthened.

Countries exiting conflict and fragility face many urgent priorities and almost invariably suffer from substantial infrastructure deficits. There is typically very little infrastructure investment during periods of fragility and conflict, and existing installations are often damaged or destroyed. The purpose of this manual is to contribute to improvements in the quality of infrastructure regulation. It does so by identifying key principles for the governance of infrastructure regulators and by suggesting how these principles can be introduced successfully and maintained over time. The introduction of cross-cutting governance principles for regulators is based on the assumption that a uniform set of governance principles can be less costly and complex for governments to implement and enforce and will provide potential investors with a more consistent and predictable regulatory environment to navigate. The manual also discusses the process of implementing regulatory governance reforms in fragile contexts. Improvements in governance frameworks for infrastructure regulators will support better and accountable regulatory decision-making, as well as increased investment and overall economic development. Case studies from relevant country experience complement and provide context to the discussion on principles.
