The organization of a Territory as a State and its admission into the Union is dependent upon the will of Congress alone By the articles of compact of the Ordinance of 1787 the Territories of the Northwest were granted the right to organize themselves as States and to be admitted into the Union as soon as their population should amount to 60,000. Upon this basis the Territories of the Northwest and those in the South, over which the Ordinance of 1787 was extended, were allowed to organize themselves as States and were received into the Union. With the enormous increase of population throughout the United States, this number was found to be too small, and a population equal to an average Congressional district was usually required. Congress has, however, absolute discretion in the matter and often makes very arbitrary use of its power. Nevada, for example, was admitted as a State in 1864 when its population was only about 20,000. In 1872 it was enacted that no State should be admitted to the Union without having the necessary population to entitle it to one representative, which according to the census of 1890 would require a population of about 174,000. appendix B. acts of congress relating to the government of the organized territories of the united states. 1) 1789, August?.
