In mid-sixteenth-century England, people were born into authority and responsibility based on their social status. Thus elite children could designate property or serve in Parliament, while children of the poorer sort might be forced to sign labor contracts or be hanged for arson or picking pockets. By the late eighteenth century, however, English and American law began to emphasize contractual relations based on informed consent rather than on birth status. In By Birth or Consent, Holly Brewer explores how the changing legal status of children illuminates the struggle over consent and status in England and America. As it emerged through religious, political, and legal debates, the concept of meaningful consent challenged the older order of birthright and became central to the development of democratic political theory. The struggle over meaningful consent had tremendous political and social consequences, affecting the whole order of society. It granted new powers to fathers and guardians at the same time that it challenged those of masters and kings. Most in the United States likely associate the concept of the child bride with the mores and practices of the distant past. But Nicholas L. Syrett challenges this assumption in his sweeping and sometimes shocking history of youthful marriage in America. Focusing on young women and girls--the most common underage spouses--Syrett tracks the marital history of American minors from the colonial period to the present, chronicling the debates and moral panics related to these unions. Although the frequency of child marriages has declined since the early twentieth century, Syrett reveals that the practice was historically far more widespread in the United States than is commonly thought. It also continues to this day: current estimates indicate that 9 percent of living American women were married before turning eighteen. In the early 1970s, a new wave of public service announcements urged parents to "help end an American tradition" of child abuse. The message, relayed repeatedly over television and radio, urged abusive parents to seek help. Support groups for parents, including Parents Anonymous, proliferated across the country to deal with the seemingly burgeoning crisis. At the same time, an ever-increasing number of abused children were reported to child welfare agencies, due in part to an expansion of mandatory reporting laws and the creation of reporting hotlines across the nation. Here, Mical Raz examines this history of child abuse policy and charts how it changed since the late 1960s, specifically taking into account the frequency with which agencies removed African American children from their homes and placed them in foster care. Highlighting the rise of Parents Anonymous and connecting their activism to the sexual abuse moral panic that swept the country in the 1980s, Raz argues that these panics and policies—as well as biased viewpoints regarding race, class, and gender—played a powerful role shaping perceptions of child abuse. These perceptions were often directly at odds with the available data and disproportionately targeted poor African American families above others.
