Excerpt from The Law of Mortmain This work, as supplementary to the subject of administration of charities already dealt with by the author in a separate volume, has been undertaken at the suggestion of practitioners. The scope of the book is confined to the Law of Mortmain and Charitable Uses as existing subsequently to 1888, in which year the old statutes dealing with these subjects were repealed, but, to a great extent, re-enacted, and the law consolidated, by the Mortmain and Charitable Uses Act. The great innovation effected by the Mortmain and Charitable Uses Act 1891 authorising alienation of real estate by will to charitable uses, and thereby sweeping away the mass of Case Law on the subject of gifts "savouring of the realty," has made it unnecessary, in the present work, to deal with the decisions decided under the prior enactments, it being thought that, after the lapse of fourteen years, few questions will now arise upon the construction of the Old Statutes.
