This selection of the major works of constitutional theory during the Weimar period reflects the reactions of legal scholars to a state in permanent crisis, a society in which all bets were off. Yet the Weimar Republic's brief experiment in constitutionalism laid the groundwork for the postwar Federal Republic, and today its lessons can be of use to states throughout the world. Returning to the Greek understanding of art to rethink its capacities, Creation and the Function of Art focuses on the relationship between techné and phusis (nature). Moving away from the theoretical Platonism which dominates contemporary understandings of art, this book instead reinvigorates Aristotelian causation. Beginning with the Greek topos and turning to insights from philosophy, pure mathematics, psychoanalysis and biology, Jason Tuckwell re-problematises techné in functional terms. This book examines the deviations at play within logical forms, the subject, and upon phusis to better situate the role of the function in poiesis (art). In so doing, Tuckwell argues that art concerns a genuinely creative labour that cannot be resolved via an ontological or epistemological problem, but which instead constitutes an encounter with the problematic. As such, techné is shown to be a property of the living, of intelligence coupled to action, that not only enacts poiesis or art, but indicates a broader role for creative deviation in nature.

French phenomenological philosopher Maurice Merleau-Ponty argued for the primary role perception plays in understanding the world as well as engaging with it. As a contributor to phenomenology, Merleau-Ponty faced his fair share of criticisms. In this new book, Douglas Low comes to the defence of both Merleau-Ponty and phenomenology. In Defence of Phenomenology uses Merleau-Ponty's philosophy to counter the criticisms raised in Vincent Descombes's Modern French Philosophy point by point, arguing that it often misunderstood or misrepresented Merleau-Ponty's philosophy. Low clarifies Merleau-Ponty's claims, then makes the case for them. He also argues against Renaud Barbaras's well-known positions that there is a break in the development of Merleau-Ponty's thought, that Merleau-Ponty abandoned his earlier phenomenology, and that Merleau-Ponty equated being with phenomena. Low also clarifies Merleau-Ponty's complex relationship to Hegel and Marx. Finally, Low addresses the later works of Jean Baudrillard and their move away from phenomenology toward a more postmodernist philosophy, in which language and mass media images dominate culture and even construct our worldview. In Defence of Phenomenology asserts that Merleau-Ponty more sensibly argued that even though humanity's interpretation of the world is influenced by language and the media, these linguistic and media messages are first suggested by a person's needful, embodied encounters with the world and with others. These messages would make little sense if they did not relate back to this more primordial encounter.

The means by which people protest—that is, their repertoires of contention—vary radically from one political regime to the next. Highly capable undemocratic regimes such as China's show no visible signs of popular social movements, yet produce many citizen protests against arbitrary, predatory government. Less effective and undemocratic governments like the Sudan’s, meanwhile, often experience regional insurgencies and even civil wars. In Regimes and Repertoires, Charles Tilly offers a fascinating and wide-ranging case-by-case study of various types of government and the equally various styles of protests they foster. Using examples drawn from many areas—G8 summit and anti-globalization protests, Hindu activism in 1980s India, nineteenth-century English Chartists organizing on behalf of workers' rights, the revolutions of 1848, and civil wars in Angola, Chechnya, and Kosovo—Tilly masterfully shows that such episodes of contentious politics unfold like loosely scripted theater. This major study discusses some of the meanings and preconditions of freedom, responsibility and social order. The author argues that these are problems of modernity. The imagination of civil society created a milieu which was at once the location and defence of social self-sufficiency in the world. The book identifies the origins of civil society in the work of Locke, Hobbes, Rousseau and the often forgotten philosophers of the Scottish Enlightnement. It shows how the assumptions of civil society, and the state of nature, fed into the sociological and philosophical discourses which emerged in the nineteenth century. The book does not ask ‘What is civil society?’; instead it asks ‘Why is civil society?’ The author concludes that through civil society, the protagonists and heirs of European modernity struggled to make their world meaningful and safe. Civil society involved the establishment of boundaries between the community of the social and the terrifying milieu of Nature.
