"On November 23, 1998, 46 states settled their lawsuits against the major tobacco companies to recover tobacco-related health care costs, joining four states (Mississippi, Texas, Florida and Minnesota) that had reached earlier, individual settlements. These settlements required the tobacco companies to make annual payments to the states in perpetuity, with total payments over the first 25 years estimated at $246 billion. The multi-state settlement, known as the Master Settlement Agreement, also imposed limited restrictions on the marketing of tobacco products ... Five years after the November 1998 state tobacco settlement, we find that most states havefailed to keep their promise to use a significant portion of the settlement funds to reduce tobacco's terrible toll on America's children, families and communities. In the 1990's, states sued major tobacco companies to obtain reimbursement for health impairments caused by the public's use of tobacco. In 1998, four of the nation's largest tobacco companies signed a Master Settlement Agreement (MSA) to make annual payments to 46 states in perpetuity as reimbursement for past tobacco-related health care costs. Some states have arranged to receive advance proceeds based on the amounts that tobacco companies owe by issuing bonds backed by future payments. The Farm Security and Rural Investment Act of 2002 requires GAO to report annually, through fiscal year 2006, on how states use MSA payments made by tobacco companies. To conduct this study, GAO surveys the 46 states.
