The book provides an updated account of justice reform in Afghanistan, which started in the wake of the US-led military intervention of 2001. In particular, it focuses on the role of international actors and their interaction with local stakeholders, highlighting some provisional results, together with problems and dilemmas encountered in the reform activities. Since the mid-1990s, justice system reform has become increasingly important in state-building operations, particularly with regard to the international administrations of Bosnia, Kosovo, East Slavonia and East Timor. Statebuilding and Justice Reform examines in depth the reform of justice in Afghanistan, evaluating whether the success of reform may be linked to any specific feature or approach. In doing so, it stresses the need for development programmes in the field of justice to be implemented through a multilateral approach, involving domestic authorities and other relevant stakeholders. Success is therefore linked to limiting the political interests of donors; establishing functioning pooled financing mechanisms; restricting the use of bilateral projects; improving the efficacy of technical and financial aid; and concentrating the attention on the ‘demand for justice’ at local level rather than on the traditional supply of financial and technical assistance. This book will be of much interest to students of Afghanistan, intervention and statebuilding, peacekeeping, and post-conflict reconstruction, as well as International Relations in general. Matteo Tondini is a researcher and a legal advisor. He has served as a project advisor to the Embassy of Italy in Kabul, Development Cooperation Unit, working within the ‘Afghanistan Justice Program’ and has a Phd in Political Systems and Institutional Change, from the Institute of Advanced Studies, Lucca, Italy.

This book is about the convergence of trends in two American institutions – the economy and the criminal justice system. The American economy has radically transformed in the past half-century, led by advances in automation technology that have permanently altered labor market dynamics. Over the same period, the U.S. criminal justice system experienced an unprecedented expansion at great cost. These costs include not only the $80 billion annually in direct expenditures on criminal justice, but also the devastating impacts experienced by justice-involved individuals, families, and communities. Recently, a widespread consensus has emerged that the era of “mass incarceration” is at an end, reflected in a declining prison population. Criminal justice reforms such as diversion and problem-solving courts, a renewed focus on reentry, and drug policy reform have as their goal keeping more individuals with justice system involvement out of prisons, in the community and subsequently in the labor force, which lacks the capacity to accommodate these additional would-be workers. This poses significant problems for criminal justice practice, which relies heavily on employment as a signal of offenders’ intentions to live a law-abiding lifestyle. The diminished capacity of the economy to utilize the labor of all who have historically been expected to work presents significant challenges for American society. SSR is a key element of the transitions out of war, aiming at the establishment of accountable and legitimate institutions able to prevent and sanction the use of violence. While recognizing the need to include local actors, donor policies still focus mostly on the state as a provider of security. Second generation SSR has emphasized the need to include local communities and recognize the existence of non-state actors in the provision of security and justice. However, recognition is not enough. This Element promotes a radical re-think of SSR in the context of conflict and war. Guiding question for the considerations is how can security sector reform be set up and implemented to contribute to constructive and inclusive state-society relations, and build the path to long-lasting peace? This Element argues that a focus on functional equivalents, minorities, gender, and human rights is key for the design, implementation, and success of SSR.
