This work attempts to counteract the essentialism of originary thinking in the contemporary era by providing a new reading of a relatively understudied corpus of literature from a ambivalently stereotyped diasporic group, in order to rethink and problematise the concept of diaspora as a spatial concept. As work situated in the Law-in-Literature movement, beyond the disciplinary boundaries of scholarship, this book aims to construct a ‘literary jurisprudence’ of diaspora space, deconstructing space in order to question what it means to be ‘settled’ in literary refractions of the lawscape by drawing on refractions of case law in a corpus of texts by Romani authors. These texts are used as hermeutic framings to draw unique spatio-temporal landscapes through which the reader can explore the refractive, reflective, interpretative conditions of legality as a crucible in which to theorise law.The radical intent of this work, therefore, is to deconstruct jurisprudential spatial order in order to theorize diaspora space, in the context of the Roma Diaspora. This work will offer readers new possibilities to re-imagine diaspora through law and literature and provides an innovative critical interdisciplinary analysis of the shaping of space.

Contemporary television fictions allow the audience to experience the reality of everyday life in audio-visual spaces. Thus, controversial issues discussed in German society such as homosexuality, racism or ‘clashes of cultures’ are revisited in the social drama films produced for German television through a mixture of generic conventions such as tragedy, thriller and melodrama. Consequently, the audio-visual representations of the people, who are the focus of these discussions, represent an interesting area of research. The book deals with the audio-visual spatiality of the Turkish diaspora in Berlin in three contemporary TV films in this format; namely Wut (Range, dir. Zuli Aladağ, 2006), Die Neue (The Newcomer, dir. Buket Alakuş, 2015) and Nachspielzeit (Extra-Time, dir. Andreas Pieper, 2015). Therewith, it brings a spatial approach to the issue of ‘polemical belonging of the Turkish Diaspora to the German national space’ within the audio-visual context. The proposed spatial approach presents an alternative argument to the assumptions of German politicians, who celebrate ‘a common German history that bases on Christian-Jewish identity, democracy and enlightenment’.

This book considers the question of spatial justice after apartheid from several disciplinary perspectives – jurisprudence, law, literature, architecture, photography and psychoanalysis are just some of the disciplines engaged here. However, the main theoretical device on which the authors comment is the legacy of what in Carl Schmitt’s terms is nomos as the spatialised normativity of sociality. Each author considers within the practical and theoretical constraints of their topic, the question of what nomos in its modern configuration may or may not contribute to a thinking of spatial justice after apartheid. On the whole, the collection forces a confrontation between law’s spatiality in a “postcolonial” era, on the one hand, and the traumatic legacy of what Paul Gilroy has called the “colonial nomos”, on the other hand. In the course of this confrontation, critical questions of continuation, extension, disruption and rewriting are raised and confronted in novel and innovative ways that both challenge Schmitt’s account of nomos and affirm the centrality of the constitutive relation between law and space. The book promises to resituate the trajectory of nomos, while considering critical instances through which the spatial legacy of apartheid might at last be overcome. This interdisciplinary book will appeal to scholars of critical legal theory, political philosophy, aesthetics and architecture.

The well-known challenges of international migration have triggered new departures in academic approaches, with 'diaspora studies' evolving as an interdisciplinary and even transdisciplinary field of study. Markers of identity define human groups: who belongs and who is excluded. These markers are often overt – language, material culture, patterns of behaviour – and are carefully nurtured between generations; other times they can be invisible, intangible, or unconscious. Such markers of identity also travel, and can be curated, distilled, or reworked in new lands and in new cultural environments. It has always been thus: markers of identity are often central to the ties that bind dispersed, diasporic communities across lands and through time. This book brings together research that discusses a very wide range of scholarly approaches, periods, and places – from the Viking diaspora in the north Atlantic, and Anglo-Saxon treasure hoards, to what DNA can and cannot reveal about human identity, to modern, multicultural Martinique, East London, and urban Africa, and the effect of the absence of geopolitical identity, of statelessness, among the Roma and Palestinians – to better understand how markers of identity contribute to the impact of diasporas.
