There has been little empirical study, however, on the impact of the “amount” of privatization on certain policy goals. This paper aims at filling that knowledge gap. Based on an analysis of private sector involvement in the enforcement of Australian and Canadian building codes, it argues that a certain threshold exists after which more privatization no longer results in effectiveness and efficiency gains. It furthermore discovers that the relationship between the public and private sector within a regime matters in reaching certain policy goals.

During the 1990s, bad government decision-making resulted in the U.S. Interstate Highway System growing by only one seventh the rate of traffic growth. The poor maintenance of existing roads is another concern. In cities around the world, highly political and wasteful government decision-making has led to excessive traffic congestion that has created long commutes, reduced safety, and caused loss of leisure time.Street Smart examines the privatization of roads in theory and in practice. In the flush of enthusiasm to make government work better, reformers from both left and right have urged government to turn as many functions as possible over to the private sector and to allow market competition instill efficiency and choice. In fact, government has been doing just this for years: every major policy initiative launched since World War II has been managed by public-private partnerships. Yet such privatization has not solved government's problems. While there have been some positive results, thee has been far less success than advocates of market competition have promised. In a searching examination of why the "competition prescription" has not worked well, Donald F. Kettl finds that government has largely been a poor judge of private markets. Because government rarely operates in truly competitive markets contracting out has not so much solved the problems of inefficiency, but has aggravated them. Government has often not proved to be an intelligent consumer of the goods and services it has purchased. Kettl provides specific recommendations as to how government can become a "smart buyer," knowing what it wants and judging better what it has bought. Through detailed case studies, Kettl shows that as market imperfections increase, so do problems in governance and management. He examines the A-76 program for buying goods and services, the FTS-2000 telecommunications system, the Superfund program, the Department of Energy's production of nuclear weapons, and contracting out by state and local governments. He argues that government must be more aggressive in managing contracts if it is to build successful partnerships with outside contractors. Kettl maintains that the answer is not more government, but a smarter one, which requires strong political leadership to refocus the bureaucracy's mission and to change the bureaucratic culture.

This study investigates the determinants of local governments' decisions to privatize public nursing homes. According to the Online Survey, Certification, and Reporting (OSCAR) 2004 data, more than 100 counties in the United States have recently divested their nursing facilities through change of ownership to nonprofit or for profit or through termination. The theoretical model used in this study proposes four broad categories of antecedents of the privatization decision: market failure, government failure, and monetary and institutional factors. County governments are viewed as rational actors, affected by a range of external and internal pressures and striving to maximize the attainment of their complex missions. The data used in this study come from the OSCAR 2004 file and several other sources. Using logistic regression analysis, the baseline (1998-2000) measures of all independent variables for 622 county-owned homes were regressed on the dummy dependent variable, indicating whether the nursing home was privatized by 2003 or not. Quantitative analysis was supplemented with two exploratory case studies. Local market competition, occupancy level, condition of the physical plant, staffing, the prevalence of privatization in the neighboring counties, and the proportion of elderly in the county were found to be significantly associated with the likelihood of nursing home divestment. The analysis supports the idea of a complex framework of managerial decision making: counties appear to be smart sellers by divesting when occupancy declines, when the physical environment deteriorates, and when private markets are relatively more competitive. They are also found to be smart owners by sustaining public ownership of thriving public facilities surrounded by failing private markets.
