The West Virginia State Constitution provides a review of the history and development of West Virginia's Constitution and an updated section-by-section analysis of its meaning. Excerpt from Brief Sketch of the Erection and Formation of the State of West Virginia: From the Territory of Virginia The following article appears as a prefix to the first volume of reported cases of the Supreme Court of Appeals of West Virginia, from the preface to which, as an explanation for its insertion in that volume, the following extract is taken: "Whilst it is not designed to attain to the dignity of formal history, is deemed proper in order that the events therein recorded may not pass from memory, and at the same time to provide some accessible memoranda, useful to the lawyer in his practice and convenient reference by all. The main events of the movement which culminated in the establishment of the state of West Virginia, are arranged in the order in which they transpired, together with such extraneous facts as it is thought proper to give, that the reader may arrive at an intelligent conclusion on the whole subject. An upper South state with nearly half a million slaves--more than any other state in the nation--and some 50,000 free blacks, Virginia witnessed a uniquely volatile convergence of slave resistance and electoral politics in the 1850s. While masters struggled with slaves, disunionists sought to join a regionwide effort to secede and moderates sought to protect slavery but remain in the Union. Arguing for a definition of political action that extends beyond the electoral sphere, Link shows that the coming of the Civil War was directly connected to Virginia's system of slavery, as the tension between defiant slaves and anxious slaveholders energized Virginia politics and spurred on the impending sectional crisis.
