La violation du droit international et du principe d’interdiction du recours à la force armée par l’Irak, qui est perçu à l’extérieur comme une puissance belliqueuse, menaçante et au comportement imprévisible, a donné lieu à une série de mesures coercitives. Le Conseil de sécurité a fait application du Chapitre VII de la Charte des Nations unies pour sanctionner l’agression de l’Irak contre le Koweït en décrétant un embargo sans précédent dans l’histoire de l’Organisation. Les sanctions ont incontestablement eu des répercussions néfastes sur la situation humanitaire en Irak. L’état nutritionnel de la population est alarmant : l’interruption des importations de nourriture a provoqué une pénurie généralisée. Des émeutes de faim se déclarent dans tout le pays. La crise de l’approvisionnement alimentaire est conjuguée à une situation sanitaire aiguë. L’adoption de la résolution 986 du Conseil de sécurité en avril 1995 constitue à cet égard une dérogation au régime des sanctions, car l’un de ses objectifs est de corriger certains des effets désastreux des dispositions adoptées et mises en œuvre à l’issue du conflit du Golfe. Il va sans dire que les effets de cet embargo ont réduit tout un peuple à une situation si dramatique dans les domaines alimentaire et sanitaire que le souci humanitaire pris en considération dans les résolutions du Conseil de sécurité apparaît dérisoire. Le présent ouvrage dresse un tableau de la situation humanitaire en Irak. Il s’attache à analyser la résolution 986 et en retrace l’actualité, de sa mise en œuvre jusqu’à aujourd’hui. Il s’interroge enfin sur le véritable débat qui entoure l’épineuse question de la réforme du régime des sanctions.

The reactivation of the Security Council at the beginning of the last decade has resulted, since the invasion of Kuwait by Iraq on August 2, l990, in increasing use of its powers under Chapter VII of the Charter and the adoption of measures against a number of state and non-state entities. The notion of a threat to the peace has now come to encompass violations of fundamental norms of international law such as human rights and humanitarian law, and the wide-ranging measures adopted have included such innovations as the establishment of the UN Compensation Commission or that of the two international criminal tribunals for Former Yugoslavia and Rwanda. These measures have not only infringed on the legal rights of the targeted state (sometimes with irreversible effects where they have remained in force over a long period of time) and its population, but also on those of implementing states and of private rights within these states. The current debate over the legitimacy and long-term effects of economic sanctions on states and their populations makes it imperative to re-evaluate this instrument and the broader peace maintenance function of the Security Council in the light of current community concerns. Part One of this book addresses the theoretical issues by focussing on: 1) The place of sanctions in the international legal system; 2) the limits to the powers of the Security Council and the question of accountability; and 3) an assessment of the alternatives to collective economic sanctions. Part Two looks at the relationship between sanctions and humanitarian issues, examining the relationship between: 1) Sanctions and human rights law; 2) sanctions, humanitarian issues and mandates; and 3) sanctions and humanitarian law. Part Three focuses on implementation by states of Security Council sanctions resolutions by examining: 1) Sanctions and private rights; and 2) special problems for implementing states. Part Four addresses the future in reassessing the place and ethics of sanctions in an international legal system which is giving increased importance to the individual. This work is based on papers presented at a colloquium of the Graduate Institute of International Studies in Geneva.

Il a comme fonction la limitation des obligations substantielles des États lors de la survenance d’un fait-condition – la situation de nécessité – afin d’éviter que l’application du droit ne génère un coût social excessif. Sa réalisation requiert toujours une pondération des intérêts en conflit. Seulement lorsqu’un coût social excessif ne peut être évité, l’état de nécessité intervient dans le cadre des obligations secondaires de la responsabilité internationale, en tant que circonstance atténuante. After much hesitation, the International Law Commission codified the state of necessity as a circumstance precluding wrongfulness in the field of State responsibility. This study aims to demonstrate that it is a much wider mechanism, essential to international law and strictly connected to its own characteristics. It performs the function of limiting the substantial obligations of States in case of the realization of a fact condition – a situation of necessity – in order to avert an excessive social cost, born out of law implementation. It always works through a balance of conflicting interests. Only when a social cost cannot be avoided, the state of necessity, under the features of a mitigating circumstance, enters the field of secondary obligations relating to international responsibility.
