El 21 de julio de 2019 se cumplieron diez años de la expedición de la Ley 1333, mediante la cual se estableció el Procedimiento Sancionatorio Ambiental colombiano, tiempo que le ha permitido a los diversos operadores jurídicos conocer y auscultar profundamente los caminos procesales dispuestos en la ley, identificar sus vacíos y debilidades, analizar sus contenidos e incluso proponer posibles modificaciones. Luego de transcurrida una década podemos ver con absoluta claridad que es fundamental contar con una herramienta jurídica que le permita al Estado imponer sanciones legales y exigir la reparación de los daños causados al entorno natural, conforme a lo determinado por el artículo 80 de la Constitución Política colombiana. La Ley 1333 de 2009 es uno de los pilares del derecho ambiental colombiano, representa la respuesta punitiva ante la generación de daños a la naturaleza o ante la desidia, el desinterés o la voluntad de un sujeto determinado de incumplir con una prohibición, obligación o condicionamiento establecido por el ordenamiento jurídico medioambiental. El derecho administrativo sancionatorio ambiental busca garantizar la preservación y restauración del ordenamiento jurídico; siguiendo lo afirmado por la Corte Constitucional en la Sentencia C-818 de 2005, debemos entender que con la imposición de la sanción no sólo se reprueban las conductas antijurídicas sino que también se previene su realización. Este último objetivo del derecho administrativo sancionador resulta especialmente relevante en materia medioambiental ya que, por su naturaleza, esta rama del ordenamiento jurídico procura principalmente la evitación del daño. Por su especial trascendencia, es vital que el iter procesal determinado en la ley permita de manera efectiva la protección del entorno; se requiere que la amenaza de la sanción sea suficiente para disuadir a los miembros de la sociedad de incumplir con lo determinado por el ordenamiento jurídico y cumplir con su deber ciudadano de proteger los recursos culturales y naturales del país, y velar por la conservación de un ambiente sano, conforme lo ordenado por el artículo 95, numeral 8 de la C.P De igual manera, la sanción le debe indicar al infractor que la vulneración de la norma trae consecuencias punitivas que afectan negativamente su situación, por lo que no estará incentivado a violar nuevamente el orden normativo.

Standing on the broken ground of resource extraction settings, the state is sometimes like a chimera: its appearance and intentions are misleading and, for some actors, it is unknowable and incomprehensible. It may be easily mistaken for someone or something else, like a mining company, for example.
